Variance to allow for a fence to be located within a drainage and utility easement that has been designated as an emergency overflow easement. Haila

The City generally allows fences to be located within drainage and utility easements if the owner enters into a fence easement agreement with the City. Code specifically does not permit fences within drainage and utility easements that have been designated as emergency overflow easements. Emergency overflow easements are intended to carry stormwater during heavy rain events. A storm sewer pipe is located within the easement, approximately parallel to the rear property line. Haila

113 Crestview Cir Variance Criteria
The property owner proposes to use the property in a reasonable manner not permitted by the zoning ordinance. The plight of the landowner is due to circumstances unique to the property not created by the landowner. The variance, if granted, will not alter the essential character of the locality. The variance is in harmony with the general purpose and intent of the ordinance. The variance is consistent with the Comprehensive Plan Haila

Staff recommends the Council adopt Resolution , approving the requested variance, subject to the conditions outlined in the report. Planning Commission Recommendation At the June 12, 2018 meeting, the Planning Commission made a motion to recommend the City Council approve the requested variance subject to the conditions outlined in the report. 113 Crestview Cir Recommended Conditions
The fencing may be installed no closer than a distance of seven (7) feet from the center of the existing storm sewer pipe. It is acknowledged that this alignment is not parallel with the rear property line. The property owner may install the fencing parallel to the rear property line should the property owner choose to do so, however, no portion of the fence shall be closer than seven (7) feet to the referenced storm sewer pipe. The property owner must locate on the site through a Gopher State One Call process, or through coordination with the City’s Public Works Director, the existing storm sewer pipe generally located along the rear property line. The property owner shall enter into a fence easement agreement with the City of Jordan. Haila
