Race 5 Official Racial Categories (Office of Management and Budget OMB, 1964; SF181 Ethnicity and Race Identification Form): Native American or Alaskan Native Asian Black or African American White or Caucasian Native Hawaiian or Other Pacific Islander **EEO Protects ethnicities as well intersects with National Origin Latinx (Hispanic) Middle Eastern, etc. Turkish? National Origin “Discrimination based on a person’s native country or part of the world, ethnicity, accent, birthplace, ancestry, culture, linguistic characteristics, common to a specific ethnic group, or because they appear to be of a certain ethnic background (even if they are not) is prohibited” 9-Aug-19

3. Color Discrimination based on skin pigmentation (e.g. many cultures function or have functioned as “pigmentocracies”) Colorism is discrimination based on complexion, shade, or tone. Religion Title VII of the Civil Rights Act protects not only people who belong to traditional organized religions such as Buddhism, Christianity, Hinduism, Islam, and Judaism, but also atheist, agnostic, and others who have sincerely held religious, ethical, or moral beliefs. 6. Age Discrimination based on age includes those who are 40 and older (exception: states like NJ) 7. Mental Disability Discrimination based on depression, for example 8. Sexual Harassment Checklist
Key Questions (Mil): Key Questions (Civ/EEO): Is the behavior sexual in nature? Is the behavior UNWELCOME? Is the behavior unwelcomed? Does the victim belong to protected status? Would a reasonable person find the behavior inappropriate? Is there a tangible employment action? Does one or more of the following exist? Did the action lead to a hostile, intimidating, or abusive work environment? Power, control and influence The university is liable and must address it Hostile or offensive environment Hostile/uncomfortable/unsafe environment
