Background
Prior to the passage of AB 2178, food pantries and non-profit charitable feeding operations had to meet the same health permit requirements as a retail food facility.
AB 2178 provides a flexible regulatory framework that still includes food safety oversight.

What Does the Law Say?
The law defines a LSCFO as a food service operation conducted solely for providing charity, and that is conducted by a non-profit charitable feeding organization.
The law specifies types of LSCFO that must register with the local enforcement agency.
Registration is required if not operating in conjunction with a permitted food bank.
Limited service charitable feeding operation
(a) “LIMITED SERVICE CHARITABLE FEEDING OPERATION” means an operation for FOOD service to a CONSUMER solely for providing charity, that is conducted by a NONPROFIT CHARITABLE ORGANIZATION operating pursuant to Chapter 10.6 (commencing with Section ), and whose FOOD service is limited to any of the following functions…

Limited Food Preparation – REGISTRATION REQUIRED
Food operation that reheats or portions commercially prepared foods with no further processing,(e.g. lasagna).
Food operation that may heat, portion or assemble a small volume of commercially prepared foods that are not prepackaged,
(e.g. sandwiches).
Food Pantry – MAY REQUIRE REGISTRATION
Pantries with shelf stable foods, whole uncut produce and cold or frozen perishable foods. Registration is required if not operating in conjunction with a food bank.
Food Pantry - NO REGISTRATION REQUIRED
Pantries with shelf-stable foods and whole uncut produce.

Facility that is preparing potentially hazardous foods which may require thawing, cooking, cooling, and reheating/hot holding.
(In Sacramento this includes: Loaves and Fishes, Union Gospel Mission, Volunteers of America, Salvation Army)
