2/19/08 BR:Why do you think “hearsay” is not allowed in court?
Today: Developing your team’s trial strategy

Our Goal.. Both sides (attorneys and witnesses) should sit together.
Over the course of the period I would like each side to discuss the overall strategy you will use to win at trial.

How.. Lead counsel should manage the discussion and be responsible for turning in your strategy report (one piece of paper.)

Your team’s strategy report should include:
Opening/Closing Statements. Direct examinations AND cross examinations of the other side. A brief statement that describes how you will prove your elements A brief statement that describes how you may attack the other side’s elements The main points of each witness and how they will contribute to your strategy.

What else should you be doing?
- Attorneys should be writing direct examination questions and getting feedback from me and members of your team (then rewriting your questions.) - Witnesses should be reading and understanding your witness statement (remember don’t memorize it word for word get the details 1st and play the rest as you want.)

What else should you be doing?
Everyone should be reading the parts about objections (we’ll get to them soon and when we do it will be very helpful if you have some prior knowledge or understanding.) Once your team’s strategy is decided, attorneys can begin outlining opening and closing statements.

Extra Work Time? Most days this class is empty 8th and 9th period. We should use this time to practice when we can. People who need extra work will be “encouraged” to attend these periods.

How did we do today? What did we accomplish? What do we still need to work on? What am I going to do tonight? What do I need from Mr. McIntosh?
