Regulation (EC)763/2008 of the EP and the Council on population and housing censuses and three implementing Regulations: Commission Implementing Regulation (EU) 2017/543 of 22 March 2017 … as regards the technical specifications of the topics and of their breakdowns Commission Implementing Regulation (EU) 2017/712 of 20 April 2017 establishing the reference year and the programme of the statistical data and metadata … Commission Implementing Regulation (EU) 2017/881 of 23 May 2017 … as regards the modalities and structure of the quality reports and the technical format for data transmission, and amending Regulation (EU) No 1151/2010

4 Legislation for the 2021 EU census programme (ii)
Commission Implementing Regulation (EU) 2018/1799 of 21 November 2018 … for the dissemination of selected topics of the population and housing census geocoded to 1 km2 grid Temporary direct statistical action (article 14 of Regulation 223/2009 on European statistics) By producing the data and metadata defined by this Regulation, Member States fulfil their obligations under the INSPIRE Directive (2007/2/EC) establishing an Infrastructure for Spatial Information in the European Community, and its implementing Regulations, with regard to geo-coded census data Resulting in reduced burden on NSIs

5 Census handbook A Eurostat manual to provide a detailed explanation of 2021 EU Census programme and a guide to implement the EU legislation Announced at last TCG meeting that the Census handbook would be published in December 2018, but delayed and is now expected to be ready in spring 2019 Publication will be available as a printed volume and online

6 Census hub The Census Hub was the main dissemination route for the 2011 EU census programme It is planned to update and re-use the Census Hub for 2021 The administrative, legal and IT issues related to disseminating Enlargement Country census data on the Census Hub are still being reviewed

7 The strategy for the EU post-2021 population and housing census
The DSS supported the strategy in March 2018: Take into account national differences and the availability of administrative data sources which will be key to developing the availability of annual data Flexibility to allow for gradual development but also stability Coherence and convergence between census and annual demographic and migration statistics. Appropriate definitions for the use of administrative data sources A Task Force of EU Member States and three Enlargement Countries is assisting Eurostat in developing new legislation to implement the strategy Target date for first data collection: 2024 reference year data to be collected in 2025

8 GDPR and statistics (i)
General Data Protection Regulation (Regulation (EU) 2016/679) applies from 25 May 2018 in all EU Member States GDPR harmonises, simplifies and streamlines the data protection rules across the EU Protects natural persons while Regulation 223/2009 on European statistics deals with confidentiality of statistical units General online guidance on its application by DG JUST: e-and-fundamental-rights/data-protection/2018- reform-eu-data-protection-rules_en

9 GDPR and statistics (ii)
Processing of personal data for statistical purposes benefits from many derogations from the normal rules GDPR provides a clear and transparent basis for additional derogations, although subject to strict conditions and safeguards In February 2018 Directors Generals of the ESS concluded that any additional derogations to the GDPR for personal data processing for statistical purposes should be assessed first at MS law level
