Article 28 Facilities Compliance Toolkit for Local Health Departments
(How to use this toolkit) Prepared by the NYS Association of County Health Officials Funding for this project was provided by the NYS Department of Health This recording provides an overview of how to use the Article 28 Facilities Compliance Toolkit for Local Health Departments. This resource was developed by the New York State Association of County Health Officials (NYSACHO) in conjunction with the New York State Department of Health.

About the toolkit These include: Credentialing (751.2)
This toolkit was developed to assist local health departments with compliance with the most frequently cited deficiencies found in reviews of LHD Article 28 facilities. These include: Credentialing (751.2) Personnel (751.6) Patients’ Rights (751.9) Operating policy and procedures (751.5) The toolkit was developed to assist with compliance with the most frequently cited deficiencies found in reviews of local health department Article 28 facilities. These include: Credentialing Personnel Patients’ Rights and Operating policy and procedures The toolkit provides examples of policies and procedures from local health departments who met or exceeded requirements in each of the four areas.

Finding the toolkit on the NYSACHO Website
Visit to access the Article 28 Resources Click on the ‘members only’ tab and login with your credentials On the menu bar, select Technical Assistance/Programs Select Education and Leadership from the submenu Scroll down and click on the Click on Article 28 Resources You can click on the toolkit graphic or text link provided to access the toolkit View the document in your web browse OR Download and/save the document on your computer by clicking the download icon Need a member login and password? Contact Using the toolkit is simple. The basic steps are listed above. I’ll give you a moment to read through the steps. Getting to the Toolkit Once you’ve logged into the Members Only portal on the NYSACHO website the horizontal menu bar at the top of the screen should change from blue to a dark red, and display additional menu options. Move your cursor over Technical Assistance/Programs and then select Education & Leadership from the sub menu.

Getting to the Toolkit From the Education and Leadership page, scroll down until you see the Article 28 text and picture icon. You can click on the toolkit picture or the text to open the Article 28 toolkit page.

The Article 28 Resources page includes an overview of the toolkit and how to use it.
Click on the toolkit icon or text to open the toolkit. The toolkit will open in a new browser window.

Using the toolkit Click on the Article 28 Toolkit picture or text to open the toolkit Download and/save the document on your computer by clicking the download icon Open the saved document from your computer folder and Click on the bookmark icon located on the right corner of the pdf program Use the bookmarks to expand and navigate through the model policies and procedures from each local health department Here’s a brief overview of the steps to follow to use the toolkit. You can download the toolkit and save it to your computer, or you can view it on-line in your web browser. Next, we’ll walk through the steps to use the toolkit.

From this page, you can download and save the document on your computer.
To save the toolkit, click on the download icon above. If you want to view the toolkit in your web browser, simply click on the bookmarks icon to access the bookmarks menu. In the next several slides, we’ll go through how to download toolkit and navigate the contents using the bookmarks feature. I’ll describe using the bookmarks in a downloaded file, but the steps are similar for using the bookmarks in your web browser.

First, to download the file, click the download icon.
Once, you click on the download icon, a dialogue box appears, and you can save the document in any folder on your computer

After you’ve saved the document, locate the folder where it was saved and open the document.
When you’re in the document, to access the policies and procedures examples, click on the bookmark icon, typically found at the left side of the screen.

Click on the arrow by each bookmarks to expand the list for that topic and view the available policies and documents.

Click on the bookmark topic you want to expand to view the sub-bookmarks.

Use the bookmarks to find the document you would like to view
Use the bookmarks to find the document you would like to view. For example, if you click on Patient Bill of Rights from Cortland County, the bookmark will take you to that document.

Additional Resources MS Word versions of each example provided in the toolkit can also be downloaded from the Article 28 Resources page on the NYSACHO website ( The word documents allow you to edit and customize a document for your local health department’s Article 28 Policies and Procedures. And that’s it. In addition to the downloadable PDF toolkit, NYSACHO has posted MS Word versions of each policy and procedure on the Article 28 Resources Page. You can download these files as well if you want to edit and customize a document for your department.

Additional Reference To view the current Article 28 regulations upon which these examples are based, go to NYSDOH website (link provided below), and search Title 10 and enter 751 in the search tool. You’ll be able to navigate to the regulations listed above from the search results If you’d like to view the Article 28 regulations related to the commonly cited deficiencies, you can access those through the New York State Department of Health website.

Searching NYCRR 10 The link to access these regulations is provided on the NYSACHO Article 28 Resources webpage. Let’s walk through searching the regulations. From the Article 28 Resources page, click on NYCRR Title 10.

Once you’re on the NYS Department of Health Rules, Regulations and Laws webpage, click on Title 10.

On the next page, click Search Title 10

In the search box, type in 751, then click the word search.

From this page, you’ll be able to browse through the regulations by click on the Section title.

Clicking on a title will bring up the full text of the regulation.
