Tension between judicial independence and accountability
Judges are state functionaries under the rule of law Independence from other state powers, is essential Paradox:, courts and judges are financed by state budget and need to account for how the money is spent How to combine judicial independence with accountability in the democratic process?

Dealing with the Paradox
Court and judges are within constitutional limits subjected to the democratic process Central control and steering competences are limited Demanding accountability is reasonable Judicial professional space is necessary Local and national management of courts and judges is crucial 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing

Towards a solution At the central level of a MoJ or a Council for the Judiciary, policymakers want to know how courts perform. Important changes in judicial organisation have nothing to do with measured performances. (e.g. judicial map) How to make independent judges perform? How to make court organisations perform? Productivity Expertise Timeliness Integrity Services 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
11
Multilevel performance measurement of judiciaries
Foss Hanssen: quantitative measurement is for political control, qualitative measurement is for professional learning Performance measurement on EU –level is for supervision (=control) Respecting judicial professional space means: performance data beyond the court organisation are not about individual judges 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
12
Problem: national performance data are measured differently
Numbers suggest calculations are possible mean, averages, timeliness in days, number of judges and so on Each country uses separate definitions of standards and measurement. In some countries measurement differs from court to court Example: when should you start counting with the time it takes to decide a case? Date of filing at the court Reception date of the filing letter Poststamp date of the filing letter Registration of the case after check of court competence Idem for the end time: Date of the judgement Experiy date for filing appeal at a higher court Date the judgement was sent to the parties National data therefore cannot be compared with data from other countries, other than at an indicative level 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
13
Making performance measurement comparable
What is necessary: Standards Standardized registration Cooperation of 27/28 member states Reliable and Valid registrations This calls for a very limited performance measurement 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
14
Performance Measurement Indicators
Production per type of cases Costs Number of Judges and court staff Productivity Time to deposition, plus time standards per type of case Independence and Impartiality Expertise Court user satisfaction 28 oktober 2019 Montaigne Centrum voor Rechtspleging en Conflictoplossing
