The new EU Waste Legislation: Implementing and Delegated Acts
Rozalina Petrova European Commission DG ENV B3 Luxembourg, 25 March 2019
2
The New Waste Legislation: Timeline
December 2015: adoption of the proposal by the Commission December 2017: provisional agreement between the Council and the EP May 2018: Adoption by the Council 14 June 2018: publication OJ 5 July 2018: entry into force 31 March 2019: deadline for IAs & DAs 5 July 2020: deadline for transposition into national law
3
Municipal waste recycling
5-year extension possible for countries with a low starting point 11 MS: EE, EL, HR, CY, LV, LT, HU, MT, RO, SK, BG Implementation plans + interim targets Single calculation method harmonised definition of municipal waste reporting input to recycling High-quality recycling of biowaste counting only biowaste that is separately collected or recycled at source as of 2027
4
Municipal Waste Landfilling
5-year extension possible for countries with high landfill rates 10 MS: EL, HR, CY, LV, LT, HU, MT, RO, SK, BG Implementation plan + interim targets Calculation rules for landfilling Landfill restrictions for separately collected waste Towards no landfilling of waste suitable for recovery by 2030
5
Packaging waste recycling
5-year derogations (15% on a single target or divided between two targets) Taking account of re-use (max. 5%) Harmonised reporting: input to recycling Ambitious targets for plastics New targets for aluminium
6
Municipal Waste Reporting
Implementing act on rules to: calculate recycling of municipal waste calculate landfilling of municipal waste count biowaste separated and recycled at source count recycled metals from incinerated municipal waste establish reporting formats for the data and the quality check report Delegated act: average loss rates Guidance: municipal waste and backfilling definitions Exchange of good practice: separate collection, calculation rules & traceability 31 March 2019 Deadline:
7
WFD: Other Acts on Reporting
Food waste: delegated act on the methodology and implementing act on the reporting format Reuse: implementing act on the methodology and the reporting format Waste oils: implementing act on the reporting format
8
Packaging Waste Reporting
Implementing acts on rules to: calculate recycling of packaging waste count recycled metals from incinerating packaging waste take account of reuse of sales packaging placed on the market for the first time count repair of wooden packaging report on reusable packaging establish the reporting formats for the data and the quality check report 31 March 2019 Deadline:
9
IAs & DAs: Planning and Meetings
On-going studies on waste reporting, reuse and waste oils to support the Commission work on reporting: final reports due 2019 Meetings Expert Group on Waste/TACs: 4 June, 15 October, 16 November, 6 December 2018, February 2019 Stakeholder meetings under the studies; position papers Adoption IA PPWD: March 2019 IAs & DA: April – May 2019 Please, note that initially the TAC meetings were planned for February but due to room availability they had to be moved to February.
10
Some key points Addressing double reporting on the old and the new targets on municipal and packaging waste Calculation point for recycling operations per material Home composting Emerging technologies combining recycling and energy recovery (eg chemical recycling) Reporting of municipal waste generation and recycling rates per material Reporting on reusable packaging Quality check reports
11
Calculation Point The weight of waste which, having undergone all necessary checking, sorting and other preliminary operations to remove waste materials that are not targeted by the subsequent reprocessing and to ensure high-quality recycling, enters the recycling operation whereby waste materials are actually reprocessed into products, materials or substances.
12
Measurement point Reporting input to recycling measured at two points:
Entry to the recycling operation Output of sorting provided that the waste is recycled further losses prior to recycling are subtracted based on sound methodologies Electronic registries Specifications for sorted materials Average loss rates End-of-waste materials
13
CP = MP1 or 2 - MP3 - MP6 - MP7 - MP9 CP = MP4 or 5 - MP6 - MP7 - MP9
CP = MP8 - MP9 MP9 CP MP2 MP4 MP5 MP1 MP8 MP3 MP6 MP7 MP5 MP6 MP1 MP1/4 = output of sorting MP3/6 = non-target materials MP5 = Potentially EoW plastics or input to reprocessor MP7 = rejected loads MP8 = product with no further processing MP9 = non-target material the CP MP1
14
Average Loss Rates (ALR)
To be established for sorted waste per waste type (and possibly sources) reflecting the waste management practices, in particular the sorting processes preferably at the level of individual sorting facilities To be used in cases where reliable data cannot be obtained otherwise (mixing of waste, shipment) To be regularly updated
15
Reporting on Reuse Defining the system boundaries
Scope of reporting: products, channels, reuse/preparing for reuse Units of reporting: mass/€ Possible data collection methods Member States can use Frequencies of data collection and use of estimates
