3 SECTOR ANALYSIS Department of Sport and Recreation

4 Introduction The Department of Sport and Recreation South Africa (SRSA) is aimed at: Developing sport and recreation in the Republic of South Africa. The department derives its mandate from the Constitution of the Republic of South Africa (1996), which requires sport and recreation to be transformed and democratised in accordance with the values of human dignity, equality, human rights and freedom, non-racism and non-sexism.

6 Policy Directives Guiding SRSA
National Development Plan (NDP) vision 2030: The following are key transformative objectives for the sport and recreation sector as outlined in the NDP 2030: Participation in each sporting code begins to approximate the demographics of the country. Medium Term Strategic Framework : Outcome 14 deals with nation building and social cohesive society which is ideal for sport and recreation. White Paper on Sport and Recreation (2012): This White Paper sets out Government’s vision, strategic objectives, policy directives, outcomes and outputs for promoting and providing sport and recreation.

National Sport and Recreation Plan (NSRP) vision 2020: The nucleus of the NSRP provides details of the three core pillars of implementation which are an (1) active nation, (2)a winning nation and (3) an enabling environment. National Sport and Recreation Act 18, 2007: To provide for the promotion and development of sport and recreation and the co-ordination of the relationships between SRSA and the Sports Confederation, National Federations (NFs) and other agencies. Constitution of the Republic of South Africa 1996: Schedule 5 (A), Provision of sport programmes by Provincial Gov. Schedule 5 (B), Provision of sport facilities by Local Gov.

Safety at Sport and Recreation Events Act No.2 of 2010: To provides for measures to safeguard the physical well-being and safety of persons and property at sport, recreational, religious, cultural, exhibitional, organisational or similar events held at stadiums or venues. South African Institute for Drug-free Sport Act, 1997 (Act No. 14 of 1997 as amended): To promotes the participation in sport free from the use of prohibited substances or methods intended to artificially enhance performance.

9 ENTITIES REPORTING TO SPORT AND RECREATION SOUTH AFRICA (SRSA)
Sport and Recreation South Africa has two entities reporting directly to it, those are: Boxing South Africa (BSA): The establishment of Boxing South Africa is the culmination of several processes. An Act of Parliament (Boxing Act, 11 of 2001) that deals exclusively with boxing and provides for the establishment of Boxing South Africa. South African Institute for Drug-Free Sport (SAIDS): The South African Institute for Drug-Free Sport (SAIDS) is a public entity established by an Act of Parliament, Act No. 14 of 1997: “To promote participation in sport free from the use of prohibited substances or methods intended to artificially enhance performance.

10 Priorities of SRSA ( ) Increase access of SA citizens to sport and recreation facilities; Provide Mass participation opportunities; Ensure transformation of Sport and Recreation; Talent development and providing athletes with opportunity of excel; Support high performance athletes to achieve success in international sport; Build a pipeline of athletes through grass roots development.

The budget showed the highest increase of 5.8% in the 2019/20 financial year. Only the 2019/20 allocated budget was 0.5% above projected inflation.

16 PURPOSE OF THE LEGACY REPORT
The purpose of this report is to provide an account of the Portfolio Committee on Sport and Recreation work during the 5th Parliament and to inform the members of the new Parliament of key outstanding issues pertaining to the oversight and legislative programme of the Department of Sport and Recreation and its entities. This report also provides an overview of the activities the committee undertook during the 5th Parliament: It actually summarises the key issues for follow-up and concludes with recommendations to strengthen operational and procedural processes to enhance the Committee’s oversight and legislative roles in future.

17 FOCUS AREAS OF THE PORTFOLIO COMMITTEE
To monitor the implementation of Transformation Charter on sport and recreation. To monitor how the MIG portion is implemented to build sport facilities. Governance issues in the sport sector. To check if the Memorandum of Understanding (MoU) between the Departments of Sport and Recreation and Basic Education on delivering school sport are met. Follow up on the implementation of the National Sport & Recreation Plan (NSRP) vision 2020. To monitor the operational and financial activities for SRSA, BSA and SAIDS.

18 FUNCTION OF THE PORTFOLIO COMMITTEE
Conducting oversight over the executive, including monitoring and overseeing the financial and non-financial performance of the Department of Sport and Recreation and its entities to ensure that national objectives are met. Processing and passing legislation and international protocols and conventions relating to sport and recreation in accordance with the Rules of Parliament and the Constitution. Participating in National and International dialogues relating to sport and recreation. Dealing with any other matters referred to the Committee by the Speaker or the National Assembly.

19 METHODS USED BY THE COMMITTEE TO OPERATE
The Portfolio Committee employs the use of a Management Committee to deal with managerial matters and the thrust of the work of the Portfolio Committee during the period under review was on oversight: Processing and completing Committee programmes, preparation for monitoring and oversight, drafting and giving input to draft reports. Committee also scrutinises Budget Votes, Quarterly Reports, Annual Reports and Strategic and Annual Performance Plans of the Department and its entities. Portfolio Committee also conducted study visits to Provinces and Municipalities in respect of the construction of sport facilities (MIG portion), social cohesion through sport participation and the Transformation of sport and recreation, except in the Northern Cape. The Portfolio Committee resolved in its Five Year Strategic Plan ( ) to prioritise its focus on the implementation of National Sport and Recreation Plan (NSRP) vision 2020 in order to make the greatest impact in the sport and recreation sector.

20 LEGISLATION AND BILLS DEALT WITH
The draft National Sport and Recreation Amendment Bill was envisaged for referral to the Fifth Parliament: In terms of legislation, the letter was written and there was a publication in the gazette and it is a Section 76 Bill. Step 1: It was submitted to the Bills office and there was no timeframe as to how long the Bill was being edited. Step 2: The Bill will be tabled as soon as the parliamentary process are finalised and the office of the chairperson to assist in fast tracking the process. Recommendation: Priority should be given to the National Sport and Recreation Amendment Bill and be tabled in the next 6th Parliament.

21 OVERSIGHT UNDERTAKEN IN THE 5TH PARLIAMENT
In the past five years, the committee emphasised the need to build capacity in order to enhance its constitutional function for oversight and accountability: Purpose of oversights undertaken: Assessing the use of the (Mass Participation and Sport Development Grant) allocated to the Provinces for the implementation of Sport and Recreation programmes; Exploring whether Provincial plans are aligned to the mandate of SRSA of implementing the NSRP vis-à-vis provincial outcomes; Monitoring the implementation of the model on sport focused schools in assisting talented athletes to achieve their potential. How Municipalities utilised the Municipal Infrastructure Grant (MIG) potion for sport infrastructure development.

22 INTERNATIONAL STUDY TOURS UNDERTAKEN
The Portfolio Committee did not undertake any International Study Tours during the 5th parliament. The Committee had planned to undertake its study tour to Cuba in 2016,17 & 18 but this did not materialise due to budgetary constraints. This non participation in international study tours had placed a significant frustration among the committee members. Recommendation: Members to consider looking at Australia and New Zealand for its international study tour.

23 STATUTORY APPOINTMENTS
The Committee conducted interviews for the Safety at Sport and Recreation Events Act (SASREA) Appeal Board candidates. The Portfolio Committee had to speedily complete the process of recommending candidates for an independent board to hear and decide on appeals against decisions made in terms of the Safety at Sports and Recreational Events Act (SASREA), Act 2 of 2010, so as to give a full effect to the implementation of the act. Example 1: Pirates and Chiefs at the Carling Cup (2 supporters died & 21 injured ahead of the July 2017 preseason friendly) in Ellis Park Stadium.

24 Obligations conferred on Committee by legislation
In terms of Section 5 of the Money Bills Amendment Procedures and Related Matters Act, No. 9 of 2009 the National Assembly, through its Committees, must annually compile Budgetary Review and Recommendation reports (BRRR) that assess service delivery and financial performance of Department of Sport and Recreation and may make recommendations on forward use of resources. The BRRR is also a source document for the Committees on Appropriations when considering and making recommendations on the Medium Term. Among other relevant authorities, the Office of the Auditor-General of South Africa (AG) was called to brief the Committee on Audit Outcomes of the Department of Sport and Recreation, Boxing South Africa and South African Institute for Drug Free Sport.

25 ISSUES TO TAKE UP IN THE 6TH PARLIAMENT
Submission of Bills: In terms of legislation, the letter was written and there was a publication in the gazette and it is a section 76 Bill. Priority should be given to the National Sport and Recreation Amendment Bill and will be tabled in the next 6th Parliament. Implementation of the National Sport and Recreation Plan Vision 2020: The 6th Parliament should consider monitoring the implementation of the recommendations and findings of the National Sport and Recreation Plan. The NSRP is an eight-year implementation plan for the sport and recreation policy framework as captured in the White Paper. International study tour: The committee also need to look at countries like Australia and New Zealand as part of international study.

Sport Betting in South Africa: The National Gambling Board which oversees and regulates the land-based gaming destinations of South Africa. It’s legislation clearly outlines the different forms of gambling that are permitted in the country, including sports betting. In South Africa, sport betting is merely on soccer which is the biggest sport code in the country but football federations and structures do not benefit from such betting. The 6th administration should approach the Department of Trade and Industry (DTI), South African Football Association (SAFA), lottery and other relevant stakeholders to engage this matter in order to find a consensus.

Implementation of Ministerial Advisory Committee on Recreation (MACRe): When considering the integration of the National Development Plan (NDP) into government plans the planning processes carried out by SRSA have a vital role to play in bringing the vision and proposals contained in the NDP to realisation. But the impact of recreation is less emphasised hence the advisory committee was established to address the issues of lack of recreation structures and policy perspective in the country. The 6th administration should take this matter forward by engaging different stakeholders on this issues. The committee should also lobby for the implementation of the recommendations made by experts and academics on Ministerial Advisory Committee on Recreation report.

28 ISSUES TO TAKE UP IN THE 6TH PARLIAMENT……cont
Reports to be debated in the house: Members will need to make sure that the oversight reports get to be debated in the house in order to make sure that the recommendations are implemented accordingly. Sport Broadcasting: The role played by the Department in dealing with legislations and regulations that affect the functioning of sport industry i.e., ICASA regulation on PSL matches broadcasting. This is a burning issues. Both PC on Sport & Recreation and Communication to have regular joint meetings to address this issue.
