Types of Leases Joint Lease:
All roommates sign the same lease. The other roommates are held responsible for the cost if a roommate does not pay. Individual Lease: Each roommate signs their own lease. They are responsible for their own rent and no one else’s.

Before signing a lease Try to see the actual property in person.
Ask for a copy of the lease and any addendums to the lease to review with either a lawyer (such as SLS lawyer), or someone more experienced. Don’t sign anything that you have not read, do not understand, or you are uncomfortable with. Know the difference between joint lease (several tenants listed on the same lease) and individual lease (only one tenant listed on the lease). If you must have roommates, pick them carefully if possible, and sign a roommate agreement with all of them. Consider getting renter’s insurance even if the lease does not require you to. Don’t rely on oral representations, get it in writing.

During your tenancy When you first move in, make sure that you complete the move-in condition report, turn it in the landlord’s office, keep a copy for yourself, and take lots of photos. Consult with your lease and any addendums to the lease every time when you are not sure about something, or if there is an issue. Always pay your rent and utilities on time (Tip: There are always late fees for paying your rent late). Keep the place clean and do not inflict damages. Know your rights and obligations under the lease. Put maintenance requests and other notices in writing and keep written records of everything.

Before you move out Give a written notification that you intend to move out at the end of the lease if the lease requires such. Request in writing that you would like to be present at the move out inspection. Clean the place very well, following any move out procedures that you’ve been given. After removing all of your belongings and cleaning the property, take lots of photos. Be present at the move out inspection.

Security deposit Security deposit cannot be used to cover last month’s rent. The landlord cannot use it as a punishment; it is used to cover damages to the property inflicted by you, unpaid utilities, etc. It is the tenant’s responsibility to provide the landlord with a forwarding address at the end of your lease. If Virginia Residential Landlord and Tenant Act (VRLTA) governs the lease, the landlord generally has 45 days from termination of tenancy, to send to the tenant a written itemized list of deductions along with any refund due. If VRLTA does not apply to the lease, the security deposit will be refunded in accordance with the provisions of the lease (and if none, in accordance with general Virginia Landlord Tenant law). If the tenant disagrees with the deductions from the security deposit, the first step is to dispute them in writing.
