3. iNTRODUCTION
The report present the status of DVA implementation and compliance by the SAPS based on oversight police station visits conducted during the period October 2016 to March 2017 at the following twenty (20) Police Stations within the North West Province:
Khuma, Morokweng, Mothutlung, Mahikeng, Kanana, Ganyesa, Marikana, Biesiesvlei, Ikageng, Huhudi, Mmakau, Mmabatho, Klerksdorp, Pudimoe, Mogwase, Ottosdal, Jouberton, Taung, Rustenburg and Ottoshoop

4. BACKGROUND:
In terms of the Civilian Secretariat for Police Service Act 2 of 2011, the Civilian and Provincial Secretariats are responsible to monitor compliance by the South African Police Stations to Domestic Violence Act 116 of 1998 [DVA].
Failure by a member of South African Police Services to comply with an obligation imposed in terms of this Act or the National Instruction (7/1999), constitutes misconduct as contemplated in the South African Police Service Act 68 of 1995.
As part of its mandate, the Department conducted Audits at the above mentioned Police Stations to assess the SAPS compliance with Domestic Violence Act and the National Instructions as per the DVA Monitoring Tool.
The Assessment was based on the following:

5. COMPLIANCE LEVEL
Assessment of Police Station was done during the 1st Quarter
(April to June 2016). Thereafter the above Police Stations were monitored quarterly to assess compliance and implementation to Departmental Recommendations by the SAPS
During the 1st quarter, the Overall performance of Police Stations ranged from 94.1% which was a significant compliance and 46.6% for non-compliance to the Act
During the 2nd the overall performance was 95.0 which was significant and for non compliance to the Act
the 3rd the overall performance was 94.4 which was significant and 54.5% for non-compliance to the Act
4th quarter the overall performance was 93.4% which was a significant compliance and 56.2% for non-compliance to the Act

The following are overall recommendations not complied with by the Police Station even after numerous visits by Monitoring Official
Not all members were trained on DVA and Sexual Offences Act, including sign language
Complainant were not requested to sign the OB or Pocket Book as an acknowledgment that their rights were explained to them

9. OVERALL RECOMMENDATION NOT COMPLIED WITH
Police Stations still experienced shortage of personnel and vehicles to deal with DVA and Sexual Offences Cases
Police Stations did not have Victim Friendly Room
Entries in Registers did not correlate (SAPS 508(a) and SAPS 508(b)
Domestic Violence related cases were not registered in the CAS

10. Non Compliance by Members
Registers were not completed according to prescripts in that, non compliance by Members were not recorded or record thereof kept
The non recording of incidents included the recording of criminal cases against members
It was in Police Station (Mmabatho) where there was an improvement in recording information on non-compliance by members, which was not initially recorded

11. Remedial Action
In orders to improve compliance to the Act and the National Instruction, the Department developed an Action List and all findings and non-compliance are recorded.
The list is shared with the SAPS and implementation of recommendations by the SAPS is monitored quarterly
Awareness Campaigns on the service offered by the Dept i.e. Through the Complaints Unit, were community members were advised to contact the Dept and report issues on poor service delivery by the SAPS were held.
Community Members were also provided with the Dept ‘s Tool Free number which is accessible 24hrs and encourage to contact the Dept for intervention

12. Remedial Action
The Department through its vigorous monitoring method, had assisted SAPS Members with the following :
Proper recording of incidents in the SAPS 508(a) and SAPS 508(b)
How to properly complete DVA forms and documents
How to complete monthly returns
Recording of incidents against Members,

13. Remedial Actions
Even though, there is still a challenge on non-compliance by other Police Station, the Dept monitor this by conducting Unannounced Police Station Visits, which are carried out during the night and weekends.
The Compliance Forum is functional, attended by IPID, SAPS and Department. Meeting are held monthly; challenges and implementation of recommendations are discussed and monitored

14. Conclusion
The method of continues monitoring throughout the financial year as introduced by the Department has started to yield positive results
As there is an improvement in the percentage of compliance by Police Stations
An increase in recording of DVA Offender by members e.g. 22 Recorded by Mmabatho Police Station

15. Conclusion
Some of the challenges; e.g. resources as experienced by most Police Stations and non-compliance by members, was communicated to the Office of the Provincial Commission for intervention
The Department will continue to monitor the action list and support Police Stations to ensure that compliance by Members results in improved service delivery to communities; more especially victims and survivors of DVA

16. RECOMMENDATIONS Internal Monitoring mechanisms should be strengthened
Station Commissioner should ensure full adherence and compliance to the provisions of the Act and National Instructions
Station Commanders should be held accountable for failing to record incidents on non-compliance by Members
