BACKGROUND HB 3, Section modified the Career and Technology Education (CTE) Allotment to include funding for campuses that are members of the New Tech Network. Additionally, HB3, Section 1.030, expanded eligibility for the CTE Allotment to include students in grades seven and eight, which was previously limited to students in Career and Technical Education for the Disabled (CTED) courses. HB 3 – Section Excerpt Sec. 48.106 [42.154]. CAREER AND TECHNOLOGY EDUCATION ALLOTMENT (a) For each full-time equivalent student in average daily attendance in an approved career and technology education program in grades 7 [nine] through 12 [or in career and technology education programs for students with disabilities in grades seven through 12], a district is entitled to: (1) an annual allotment equal to the [adjusted] basic allotment multiplied by a weight of 1.35; and (2) $50 for each of the following in which [, if] the student is enrolled: (A) [in] two or more advanced career and technology education classes for a total of three or more credits; (B) a campus designated as a P-TECH school under Section ; or (C) a campus that is a member of the New Tech Network and that focuses on project-based learning and work-based education.

BACKGROUND HB 3, Section 1.030, modified the Bilingual Education Allotment and established different funding multipliers based on the language program in which a student participates and the student’s English Learner (EL) status. HB 3 provides Bilingual Education Allotment funding for students who participate in the Bilingual Dual Language Immersion/Two-Way program regardless of their LEP/English learner (EL) status. Funding levels vary depending upon whether the student is: LEP/English learner (EL) Not LEP/English proficient (EP) Reclassified from LEP/English learner (EL) status Former LEP/EL.

HB 3 – Section (Excerpt) Sec [42.153]. BILINGUAL EDUCATION ALLOTMENT. (a) For each student in average daily attendance in a bilingual education or special language program under Subchapter B, Chapter 29, a district is entitled to an annual allotment equal to the [adjusted] basic allotment multiplied by: (1) for a student of limited English proficiency, as defined by Section : (A) 0.1; or (B) 0.15 if the student is in a bilingual education program using a dual language immersion/one-way or two-way program model; and (2) for a student not described by Subdivision (1), 0.05 if the student is in a bilingual education program using a dual language immersion/two-way program model.

Definition: BILINGUAL/ESL-FUNDING-CODE indicates the language program in which the student participates during the reporting period.

ALTERNATIVE-LANGUAGE-PROGRAM
TAC § states that an LEA may apply for an alternative language program waiver if a local education agency (LEA) is unable to provide a bilingual education or English as a second language (ESL) program due to an insufficient number of appropriately certified teachers. To track this, the ALTERNATIVE-LANGUAGE- PROGRAM (E1642) data element has been added to the StudentProgramExtension, as mandatory, for the PEIMS Fall Submission.

DUAL LANGUAGE IMMERSION PROGRAM (TREx)
Texas Administrative Code (TAC) §74.5 requires that a student who satisfies a LOTE graduation credit requirement by successfully completing a dual language immersion program at an elementary school in accordance with criteria outlined in §74.12(b)(5)(F) must have the credit clearly indicated on the transcript. To successfully complete a dual language immersion program, a student must: participate in a dual language immersion program for at least five consecutive school years; achieve high levels of academic competence as demonstrated by performance of meets or masters grade level on the State of Texas Assessments of Academic Readiness (STAAR®) in English or Spanish, as applicable; and achieve proficiency in both English and a language other than English as demonstrated by scores of proficient or higher in the reading and speaking domains on language proficiency or achievement tests in both languages.

SB 2432 Background Under SB 2432 , TEC section (a) is expanded to allow the removal of a public school student from the classroom following engaging in conduct that contains elements of the offense of harassment under Section 42.07(a)(1), (2), (3), or (7) Penal Code, against an employee of the school district. Legislation AN ACT relating to the removal of a public school student from the classroom following certain conduct. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section (a), Education Code, is amended to read as follows: (a) A student shall be removed from class and placed in a disciplinary alternative education program as provided by Section if the student: … (2) commits the following on or within 300 feet of school property, as measured from any point on the school's real property boundary line, or while attending a school-sponsored or school- related activity on or off of school property: (G) engages in conduct that contains the elements of the offense of harassment under Section (a)(1), (2), (3), or (7), Penal Code, against an employee of the school district.

SB 179 Background SB 179 (85th) - Legislation SECTION 3. Subchapter A, Chapter 37, Education Code, is amended by adding Section to read as follows: Sec PLACEMENT OR EXPULSION OF STUDENTS WHO HAVE ENGAGED IN CERTAIN BULLYING BEHAVIOR. (a) In this section: (1) "Bullying" has the meaning assigned by Section (2) "Intimate visual material" has the meaning assigned by Section 98B.001, Civil Practice and Remedies Code. (b) A student may be removed from class and placed in a disciplinary alternative education program as provided by Section or expelled if the student: (1) engages in bullying that encourages a student to commit or attempt to commit suicide; (2) incites violence against a student through group bullying; or (3) releases or threatens to release intimate visual material of a minor or a student who is 18 years of age or older without the student's consent. (c) Nothing in this section exempts a school from reporting a finding of intimate visual material of a minor.

District, Campus, Charter For a student reported with a DAEP assignment, they must have been at least 6 years old on the date the incident occurred. If a student has committed a mandatory DAEP assignment behavior and was placed in an in-school or out-of-school suspension setting pending the completion of "due process" for that incident, then there should also be a disciplinary action reporting that the student was assigned to a DAEP. If the incident is also a discretionary expulsion reason, then the disciplinary action may be an expulsion. Student harassment of an employee of the school district results in a mandatory DAEP placement and therefore has been added to this rule.

District, Campus, Charter If a student is reported with a TX-DisciplinaryActionReason for "conduct punishable as a felony" (02), "possessed, sold, used, or was under the influence of marihuana or other controlled substance" (04), "possessed, sold, used, or was under the influence of an alcoholic beverage" (05), "abuse of a volatile chemical" (06), "public lewdness or indecent exposure" (07), "assault under penal code §22.01(a)(1) against a school district employee or volunteer" (27), "assault under penal code §22.01(a)(1) against someone other than a school district employee or volunteer" (28), "engages in deadly conduct" (49), or "harassment against an employee of the school district" (60), then the TX-BehaviorLocation must be reported as "on campus" (01), "off-campus, within 300 ft" (02), or "off-campus, at school related/sponsored activity" (03). Legislation specifies that harassment against an employee of the school district takes place in the indicated behavior locations. Note: Disciplinary Action Reason Code 02 (Conduct Punishable As A Felony) is being added to rule after previously being overlooked from (a)(2) as a behavior related to these behavior location codes. This change is not related to the addition of harassment against an employee.

Background Under HB 692, suspensions for homeless students are addressed. A student who is homeless cannot be placed in out of school suspension unless the student engages in conduct described in TEC (c) 1-3. TEC 37 HB 692 AN ACT relating to the suspension of a student who is homeless from public school. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section , Education Code, is amended by adding Subsection (d) to read as follows: (d) A school district or open-enrollment charter school may not place a student who is homeless in out-of-school suspension unless the student engages in conduct described by Subsections (c)(1)-(3) while on school property or while attending a school-sponsored or school-related activity on or off of school property. The campus behavior coordinator may coordinate with the school district's homeless education liaison to identify appropriate alternatives to out-of-school suspension for a student who is homeless. In this subsection, "student who is homeless" has the meaning assigned to the term "homeless children and youths“under 42 U.S.C. Section 11434a.

Dual Credit Reporting Dual-credit course completion is part of the Student Achievement Domain in the accountability system. Currently, if a student is enrolled in and passes a dual-credit course, college credit hours must be reported (greater than 0). Upon initial review, local education agencies (LEAs) appeared to be overreporting the college credit hours earned by students for dual-credit courses. Dual-credit courses examples: A dual credit course that is the equivalent of a single college course and is taken over more than one high school semester; A dual credit course that is the equivalent of a single college course and is taken in one high school semester; A dual credit course that is the equivalent of two college courses and is taken over more than one high school semester; A dual credit course that is the equivalent of two college courses and is taken in one high school semester. This research prompted the TEA to consider improvements and clarifications to how dual-credit courses are reported.

Dual CREDIT REPORTING The COURSE-SEQUENCE-CODE (C135) is updated to include additional codes for purposes of reporting dual-credit courses only. The addition of dual-credit codes will allow LEAs to report dual-credit courses more accurately.

Zoned School (transfers accepted) A school in which enrollment is based on the student’s home address but transfers of students from other schools or districts are accepted, including the children of district employees. The school may accept inter- and/or intra-district transfers.

If an open-enrollment charter school specializing in performing arts, consideration may also be given to whether the student demonstrates artistic ability.

Enrollment in these schools may or may not be based on the student’s home address. This school may be operated by an open enrollment charter school or an independent school district. This enrollment type may not be included in the Combined Enrollment Type School.
