2 Clerks’ DIY Project The FCCC Board of Directors initiated a Statewide DIY Project in early 2019 On August 29th, 2019, the Civitek Board of Managers approved a contract with a company named Intresys Intresys currently provides many online interactive DIY forms to Florida Clerks under the name “TurboCourt” Civitek is funding startup costs for the project Civitek will also pay a monthly fee to Intresys for statewide use of their online interactive DIY forms

Each Clerk participating will promote the DIY Service with a link on their web site. Other marketing material will be made available. Intresys will host customized landing web pages that are branded to each Clerk’s office. Initial offerings: Eviction Family Domestic Violence Future offerings: Small Claims Year 3 Guardianship in Year 4

4 Clerks’ DIY Project - Scope
DIY users can print the forms and file them OR e-file them through the e-Filing Portal (efiling available 6 months after startup). There is no cost to the individual Clerk’s offices to participate. DIY users will pay a $10 fee to access each form. (Current fees range from $24.95 to $ ) The system will also collect any filing fees if the user opts to efile the document. These fees will be electronically routed to each Clerk’s office. Domestic Violence forms will be free.

5 Clerks’ DIY Project - Contract
Intresys is required to insure that the forms generated through the TurboCourt system for use in Florida are at all times approved by Supreme Court of Florida. Use of the TurboCourt System by Clerks is optional. The agreement between CiviTek and Intresys is non-exclusive, permitting CiviTek to provide services to Clerks that do not use the TurboCourt system for DIY forms. The system use fee per form to users of the TurboCourt system will be $10.00, and this fee cannot be increased without agreement by both CiviTek and Intresys.

6 Clerks’ DIY Project - Contract
During the first year of the agreement, CiviTek will retain all system use fees. During the second year of the agreement, and every year afterwards, CiviTek will retain all system use fees up to the base case transaction volume; any amounts over that base case volume will be split with Intresys to receive 70%, and CiviTek to retain 30%. CiviTek has the ability to terminate the agreement if after the second contract year, the Clerks in Florida do not achieve at least 70% of the base case transaction volume for the second year. CiviTek will assist by creating the landing pages for participating Clerks. CiviTek will NOT be processing payments for the forms, Intresys will be doing that.

7 Clerks’ DIY Project - Contract
If at any time during the term of the agreement the TurboCourt- generated forms are no longer approved by the Supreme Court of Florida, or otherwise not permitted to be used in the courts of Florida, CiviTek may terminate the agreement if the forms cannot be amended to permit their use in Florida. The agreement is governed by Florida law, and venue for any disputes under the agreement is in the courts of Florida. For each Clerk that wishes to use the TurboCourt system, an agreement will be prepared between CiviTek, the Clerk, and Intresys.
