An (1) unstabilized situation which includes at least one (2) harmful event and involves one or more (3) motor vehicles

Unstabilized An unstabilized situation is a set of events not under human control, or not intentional Does not include legal intervention (P.I.T) or deliberate intent (suicide)

A harmful event is an occurrence of injury or damage. Injury is bodily harm to a person Does not include effects of diseases Damage is harm to property that reduces the monetary value of that property. Does not include mechanical failure during normal operation, such as a tire blowout, etc

Motor vehicle – any motorized (mechanically or electrically powered) road vehicle not operated on rails Includes : ATV’s, Snowmobiles, etc Excludes : Bicycles, Trains, Airplanes, Animals, etc

State Law Any incident involving a motor vehicle that results in any injury OR damage ($1500 or more) Damage is not limited to the motor vehicle only Plus Incident originated or occurred on a trafficway Excludes parking lot aisles or stalls

(c) The accident reports shall: (i) provide sufficient detail to disclose the cause, conditions then existing, and the persons and vehicles involved in the accident; and (ii) contain all of the information required that is available.

The term “in transport” denotes the state or condition of a transport vehicle which is in motion or within the portion of a transport way ordinarily used by similar transport vehicles. (ANSI D16.1-2007)

The classification of any vehicle, part of a vehicle, cargo of a vehicle, or occupant of a vehicle, remains the same from the time the unstabilized event begins until it ends.

Use Suspected Any suspected use of drugs or alcohol by driver – regardless of level Test Given Any type of chemical test that provides a measurable or detectable amount Test Result Positive or negative result regardless of amount

Test Given If tests being done by O.M.E – “05” Taken to M.E. Test Results “Pending” results need to be amended if collected by officer (DUI)
