Getting the balance right The Government’s role is to get the balance right to reduce alcohol-related harm by making sure that: licensed premises sell alcohol in a responsible way people can make informed decisions about how much they drink

The code of practice The aim of the code is to: – reduce alcohol-related public nuisance, crime and disorder – promote public safety – protect children from harm – make the healthy choice easier for consumers The code is made up of proposals for: mandatory licensing conditions – Food Safety Act requirements on the display of alcohol unit and health information – discretionary local licensing conditions – statutory guidance that local authorities must have regard to

Mandatory conditions Summary 1.banning irresponsible promotions 2.banning dispensing directly into the mouth – eg “gunslinger” promotions 3.ensuring smaller measures are always available 4.ensuring free tap water always available 5.making it more difficult for under 18s to buy alcohol online or mail order Making a healthier choice easier for all off and on-trade the UK unit content of a representative sample of drinks must be displayed for off-trade information about health risks must be displayed

Discretionary local conditions there has been public nuisance or disorder on or near those premises the nuisance or disorder is associated with consumption of alcohol on, or supplied by, those premises there is likely to be repetition of alcohol-related nuisance or disorder the conditions would mitigate or prevent the nuisance or disorder Licensing authorities may impose the prescribed local conditions on two or more premises in an area where they consider: As well as interested parties and responsible authorities making representations, licensing authorities will be able to initiate action themselves

Guidance Statutory guidance: section 182 statutory guidance for licensing authorities on the new conditions and processes new statutory guidance under section 40 Food Safety Act 1990 for food authorities “Best Practice” guidance: good practice that licensing authorities should be aware of when building evidence prior to imposing conditions new and existing industry codes to demonstrate what makes well- run premises
