Structure of DLA & AA Non Contributory, Non Means Tested, Non Taxable Can work as well as claim them Paid on top of means tested benefits (disregarded as income) Attract extra premiums on means tested benefits Passport to other types of help & benefits

Differences between DLA & AA DLA is for people who claim for the first time before age 65 but can be paid after age 65 if claimant already in receipt AA is for people who claim when 65 or over

Differences between DLA & AA DLA has two components, Care & Mobility AA only covers care needs & pays noyhing for mobility DLA has 3 levels of care AA has 2 levels of care If person has mobility difficulties it is important to claim DLA before age 65

Qualifying conditions Under 65 – DLA Over 65 – AA and Satisfy disability tests for 3 months (DLA) or 6 months (AA) before the claim Expect to satisfy the tests for next 6 months

Qualifying conditions Terminally ill – claim under “Special Rules” 3 & 6 months qualifying condition does not apply “Terminally ill” is strictly defined DS1500 form signed by GP, Consultant etc.

DLA Mobility Component Must be aged 5 or over for the Low Rate & 3 or over for the High Rate Must be able to benefit from being mobile – e.g. not in a coma or too dangerous a condition to be moved

Mobility Component Higher Rate Unable to walk at all Virtually unable to walk - without severe discomfort Exertion of walking could endanger life or cause serious deterioration in health Both deaf & blind No legs or feet Receive higher rate Care component, severely mentally impaired & severe behavioural problems

Virtually unable to walk Ability to walk is limited due to: The distance over which, or The speed at which, or The length of time for which, or The manner in which You can make progress on foot without severe discomfort

Mobility Component Lower Rate Can walk but cannot make use of ability to walk without supervision or guidance from another person for most of the time when walking on unfamiliar routes out of doors

Care Component Disability Conditions Must suffer physical or mental impairment such that you require one or more of the following:

Part-Time Day Care Attention in connection with bodily functions for a significant portion of the day Cannot prepare a cooked main meal given the ingredients and aged 16+

Day-Time Frequent attention in connection with your bodily functions throughout the day Continual supervision to avoid substantial danger to self or others throughout the day

Night-Time Prolonged or repeated attention in connection with bodily functions during the night Someone to be awake watching over you for a prolonged period or at frequent intervals to avoid substantial danger to self or others during the night

How do you qualify for the different rates of Care High Rate – Terminal illness or both day & night supervision and/or attention needs. Middle Rate – Day or night supervision and/or attention needs Low Rate – Part-Time day care needs or the cooking test
