3 LEGISLATION REQUIREMENTS Workplace Injury Management & Workers Compensation Act 1998 - prompt treatment of injuries, - effective and pro-active management of injuries - rehabilitation of injured worker - Promote return to work ASAP WIM & W/Comp. Regulation 2002 - Return to Work (RTW) Program - Significant Injury - Return to Work (RTW) Plan

4 What is Injury Management (WIM) and why is it important? It is the process of getting an injured worker back to work as soon as they are able. Early return to work (RTW) can reduce: - lost productivity, - poor morale, - the possible loss of a valued worker - replacement cost - loss of customers

9 ACTION WHEN AN INJURY OCCURS Case Study – Worker slips over and seriously injures back. - Report injury to employer/call for help - Isolate machinery or area, if required - Render first aid - Arrange ambulance or other transport - Conduct investigation/interview injured worker and witnesses - Record details in Register of Injuries - Notify Insurer - Obtain WorkCover medical certificate from injured worker, if required by Insurer

10 POST INCIDENT PROCESS What To Do - Communicate with NTD, worker, Rehabilitation Provider - Determine Suitable Duties subject to what is available and their restrictions - Effect upon other workers - Prepare a RTW Plan - Maintain Contact with NTD - Review and Upgrade RTW Plan - Rehabilitation elsewhere

11 WORKERS COMPENSATION FRAUD Types of fraud - false claim - overcharging - prolonging claim - false diagnosis - working elsewhere (most common) Reporting fraudulent activity - Insurer/WorkCover NSW Referral forms - by employer, insurer and worker
