5 RIGHTS OF A FILIPINO CHILD What is a child?  A person who is eighteen (18) years old or younger  A person who is above eighteen years old but is unable to fully take care or protect himself from abuse, discrimination, exploitation, neglect, or cruelty because of physical or mental disability or condition

6 RIGHTS OF A FILIPINO CHILD 1 To be born. To have a name and nationality 2 To be free. To have a family who will take care of me 3 To have a good education 4 To develop my potentials 5 To have enough food, shelter, a healthy and active body

7 RIGHTS OF A FILIPINO CHILD 6 To be given the opportunity for play and leisure 7 To be given protection against abuse, danger & violence brought by war & conflict 8 To live in a peaceful community 9 To be defended and assisted by the government 10 To be able to express my own views

8 Role of the state  To provide special protection to children from all forms of abuse, neglect, cruelty, and discrimination, and other conditions prejudicial to their development including child labor and its worst forms  To provide sanctions for their commissions & carry out programs for prevention and deterrence of & crisis intervention in situations of child abuse, exploitation and discrimination

9 Role of the state  To intervene on behalf of the child when the parent, guardian, teacher, or person having care or custody of the child fails or is unable to protect the child against abuse, exploitation and discrimination, or when such acts against the child are committed by the said parent guardian, teacher, or person having care and custody of the same  To protect and rehabilitate children gravely threatened or endangered by circumstance which affect or will affect their survival and normal development and over which they have no control

10 EMPLOYABLE AGE  No child below 15 years of age shall be employed.  Any person between 15 and 18 years of age may be employed for such number of hours and such periods of the day  No child below 18 years of age shall be employed in hazardous or deleterious nature of work

11 EMPLOYABLE AGE  Child works directly under the sole responsibility of his parents/ legal guardian  Employment shall not endangers life, safety, health and morals or impairs the child normal development  The child shall be provided with the prescribed education

12 EMPLOYABLE AGE  Child shall work for not more than 20 hours a week  The work shall not be more than 4 hours at any given day  The child does not work between 8pm and 6am the following day  A work permit from DOLE shall be secured in exceptional cases where any child may be employed

14  The employment contract is concluded by the child’s parent or legal guardian, with express agreement of the child concerned  A child below 15 years of age maybe allowed to work for not more than 20 hours a week  A child 15 years of age but below 18 shall not be allowed to work for more than 8 hours a day an in no case beyond 40 hours a week Rules & regulations

15  No child below 15 years of age or 15 years of age but below 18 shall be allowed to work between 10pm and 6am of the following day  No child below 18 years of age shall be employed as a model in any advertisement directly or indirectly promoting the following:  alcoholic beverages  intoxicating drinks  tobacco and its by-products  gambling  any form of violence or pornography

18  All forms of slavery or practices similar to slavery sales and trafficking of children debt bondage and serfdom forced or compulsory labor (including recruitment of children for use in armed conflict)

19  Use, procuring, offering or exposing of a child for prostitution, for the production of pornography, or for pornographic performances  Use, procuring or offering of a child for illegal or illicit activities, including production and trafficking of dangerous drugs and volatile substances prohibited under existing laws

20  Work, which by its nature or the circumstances in which it is carried out, is hazardous or likely to be harmful to health, safety, or morals of children

21  Debases, degrades or demeans the intrinsic worth and dignity of a child as a human being  Expose the child to physical, emotional, or sexual abuse, or is found to be highly stressful psychologically or may prejudice morals  Performed underground, underwater, or at dangerous heights  Involves the use of dangerous machinery, equipment, and tools such as power-driven or explosive power-actuated tools

22  Performed in an unhealthy environment exposing the child to hazardous working conditions, elements, substances, co-agents, or processes involving ionizing, radiation, flammable substances, fire, noxious components, and the like, or to extreme temperatures, noise levels or vibrations  Performed under particularly difficult situations

23  Exposes the child to biological agents such as bacteria, fungi, viruses, protozoans, nematodes, and other parasites  Involves the manufacture or handling of explosives and other pyrotechnic products
