Data Access Agreement All textual metadata provided via the BioCASe provider software is under the terms of the Creative Commons Zero Public Domain Dedication (CC0 waiver) All other content, such as previews, soundbits, and the content referenced by URI (web addresses) in the metadata do not fall under the CC0 waiver and remain completely under the control of the Content Provider.

5 www.open-up.eu Europeana Data Exchange Agreement Two principles: 1.Data providers grant Europeana the right to publish previews provided to Europeana 2.For all other metadata provided to Europeana, data providers grant Europeana the right to publish the metadata under the terms of the Creative Commons Zero Public Domain Dedication CC0.

6 www.open-up.eu Content, Previews and Metadata The 4 layers: 1.Physical objects 2.Digital representations of physical objects 3.Previews/thumbnails 4.Descriptive metadata As far as Europeana is concerned, layers 1,2 and 3 are content. The rights to Content are under the provider’s control. Everything in layer 4 is public domain (CC0)

7 www.open-up.eu Creative Commons Zero Designed for Data Re-use of data is free from all restrictions Copyright and similar rights waived In jurisdictions where copyright cannot be waived, provides a condition-free licence. In jurisdictions where such a licence would be invalid, asserts that rights holder will not exercise rights Commercial use permitted Citation not required

8 www.open-up.eu Europeana Data Use Guidelines Attribution strongly recommended but not a formal licensing condition Dynamic metadata – recommend Europeana APIs Acknowledge modifications No endorsement No warranty

9 www.open-up.eu Tricky Considerations Non Commercial – What does this actually mean? – Unintended consequences Attribution – Different cultures, different emphasis – Burdensome (stacking) – Policing adherence to licence terms?

10 www.open-up.eu Rights Statements Providers must state under what terms the viewer can access and use the digital objects Four classes of rights statements: 1.Public Domain – out of copyright 2.Creative Commons (six types) 3.Rights Reserved (three types) 4.Unknown – last resort
