Environment Agency Powers The EA has permissive powers with regard to flood defence under the Water Resources Act 1991 and the Land Drainage Act 1991 This means that we may act to carry out works, but we are not obliged to. The new Floods and Water Bill will not affect these basic powers.

Constraints We can only use public money to defend existing property We cannot speculatively provide defences to allow development. Under PPS25 if there is no land at lower risk of flooding on which to build, the developer may provide suitable defences.

Appraisal HM Treasury – ‘Green Book’ Best practice guide to carrying out the appraisal and evaluation of policies and projects funded by central government. Preferred method of evaluation: cost benefit analysis. Defra – Flood and Coastal Defence Project Appraisal Guidance 3 – Economic Appraisal (PAG3) Guidance on the application of the ‘Green Book’ methodology to flood and coastal risk management schemes.
