1 Individual Rights and Responsibilities

2 What is a Responsibility? Something I agree to do to the best of my ability.

3 My Responsibilities….. To do the best job I can do. To treat others with respect. To only have things that belong to me. Cooperate with staff and co-workers.

4 What is a Right? Something that I am allowed to do or have all the time.

5 It is all about me! O I am the most important person on my team! O I have wishes, hopes and dreams and I can tell my team what they are. O Sometimes there are Steps for me to make Before I reach my goals.

6 I have a right to understand O I have a right to have information given to me in a way I can understand. That may mean… O Braille O Large print O Picture communication

7 I have the right to stop or refuse services from ProAct. I may not like how things are going so I can… O Go to the “Boss” and explain why I want to stop or refuse services. O Remember that people may not agree with me because by doing so I may get sick or harmed. O Remember that I could lose my services and not get them back easily.

8 I have a right to know if there are any limits to my services. I need to… O Learn about what services I can and can not get. O Be willing to check out all of my options for services. O Try to use the services I have to get the things I need.

9 I have the right to know what the initiation (start) and termination (stop) terms are. I need to…. Remember that initiation means “start” and termination means “stop”. Know the policies and routines for ProAct. Know that I cannot be discharged without explanations being given and understood. Listen to the reasons why services are being stopped. Learn about my appeal rights. I can ask questions about what they said or did.

10 I have a right to know what it costs to work here. O ProAct will tell me how much my services cost. O I will be notified if that amount changes.

11 I have a right to know who pays for my services. O Waiver funds O Social Services O Rehabilitation Services O ARHMS funds O Insurance O Private Pay

12 I have a right to have staff who are trained and know how to help me. O Staff are trained about my rights and responsibilities. O Staff know how to keep me safe. O Staff work with me to help me become a better worker O Staff have demonstrated they understand how to keep me safe and healthy.

13 I have the right to have information about me kept private O Staff can only talk to others about me if my guardian and I say it is okay. O Information about me may include personal, financial, medical, behavioral, etc.

14 I can see the information in my file. O I have a right to see what is written about me in my file. O I need to ask to see it. O It is okay to ask for clarification if there is something I do not understand. O I need to return the material in the same condition I received it.

15 I have a right to be free from maltreatment O I have a right to be safe from O Abuse/humiliation O Neglect O Financial Exploitation Staff will call the Common Entry Point or the police If anyone tries to hurt me.

16 No restraint or seclusion O I don’t have to worry about staff restraining me or secluding me from others. O Staff may only use these measures if I’m in danger of hurting myself or others.

17 I have the right to work in a safe environment. O It is important that the ProAct is a safe place to work. O No things blocking the isles O Clean work area O Organized I can help make sure ProAct is a safe place by helping clean up my workspace, throwing my garbage and telling staff when things are broken.

18 I have a right to be respected for who I am. O I understand that people should treat me with respect. O I think that people should respect my own personal property. O I understand that people should respect my culture/heritage as well as the way that I communicate. O I do not think that people should talk about me without my permission. O I also need to treat others with the same respect.

19 I have the right to observe my ethnic and/or religious beliefs O I may participate in ethnic and religious activities of my choice. O I understand others may have different customs than me.

20 I have the right to be free from bias and harassment. O I need to tell staff if anyone says bad things about me because of my race, color, creed, sexual orientation, religion, disability, national origin, age, marital status, sex, ability to pay or public assistance status. O I have the right to appeal to Steve Ditschler, President, or Sally Ogren, Director of Services if I feel I have been treated unfairly.

21 I have a right to make a complaint. O If I have a problem, I can tell my staff or case manager at ProAct. O They will help me to the best of their ability. O I can’t get in trouble for asking for help.

22 I have the right to file a grievance if I need to. O If I have a problem, dispute or difference of opinion with someone, I can report it and ask for assistance. O If I’m not happy with the outcome, I can file a grievance. The facts will be investigated and recorded and a decision will be made. O No retaliation can happen because I made a report.

23 I have the right to know about other people who can help me. O I can contact these people to help me advocate for what I want and need: O My Social Worker O MN Office of the Ombudsman O MN Department of Human Services O ARC Greater Twin Cities and Rochester

24 Others who are on my team to help me… O Guardians/conservators O Family O Social Worker O Residential staff

25 I have the right to say no to research and experimental treatment. O ProAct does not do any research or experimental treatment but if they did, I have the right to not participate. I can say no and mean it!

26 I have the right to use a phone O I can make local calls from a ProAct phone on my break time. O Everyone is asked to limit calls to 3 minutes. O If I need to call long-distance I can talk to my case manager for assistance. O I need to remember to put my cell phone away during work time.

27 I have a right to send mail and open mail addressed to me. O I can open my own mail and e-mails. O I can give permission for someone else to help me like staff or a guardian. O I can send mail and e-mails without someone reading it. O I may need someone to help me understand the mail I receive.

28 I have a right to have time by myself. O I should tell people when I want to be alone. O At ProAct I can ask to rest in the Quiet Room if I need time to relax. O I can close my bedroom door at home for privacy when I want to be alone. O I need to close the restroom door. O Other people need to knock on my door and wait for me to say they can come in. O I can tell people to go away if I want to be alone. O I need to respect other people as well if they want to be alone.

29 I have a right to Privacy If I’m married, I have a right to private time with my husband or wife.

30 I have a right to have friends. I need to… O Learn the best ways to have a friend and be a friend. O Know that staff cannot tell me who my friends are or who I can be friends with. O Remember that I have to be nice and flexible. O I should reschedule if I forgot to go somewhere with someone. O At work, I can talk to my friends at break time.

31 I have a right to plan activities I like to do. I know I need to…. O let people know what I want to do. O save my money so I can afford to do things. O ask people to help make arrangements for tickets and transportation. O I understand things may not always work out when I want them to.
