LET THE TRAIN TAKE YOU THERE… REGULATORY REQUIREMENTS Federal Railroad Administration will be SMART’s Regulator The SMART application requires either FRA-compliant or alternate-compliant vehicles; however, alternate compliance requires temporal separation The FTA requires Buy America compliance if Federal funds are used The EPA requires Tier 4 diesel engines, unless TPEM exemptions are employed

RECOMMENDATION Staff recommends FRA-compliant technology for the following reasons: FRA-compliant technology erases all regulatory concerns, improving the likelihood of achieving project implementation FRA-compliant technology is more consistent with the pledge to reduce harmful emissions quoted in the EIR documents FRA-compliant technology offers less risk than alternate-compliance technology provided under TPEM program auspices
