6. How are Offense Codes Created? Sec. 42.06. FALSE ALARM OR REPORT. (a) A person commits an offense if he knowingly initiates, communicates or circulates a report of a present, past, or future bombing, fire, offense, or other emergency that he knows is false or baseless and that would ordinarily: (1) cause action by an official or volunteer agency organized to deal with emergencies; (2) place a person in fear of imminent serious bodily injury; or (3) prevent or interrupt the occupation of a building, room, place of assembly, place to which the public has access, or aircraft, automobile, or other mode of conveyance. (b) An offense under this section is a Class A misdemeanor unless the false report is of an emergency involving a public or private institution of higher education or involving a public primary or secondary school, public communications, public transportation, public water, gas, or power supply or other public service, in which event the offense is a state jail felony. 7. OFFENSE CODES (vs.14)  Offense Codes are created by the DPS CJIS Supervisor at the end of the Legislative Session every 2 years and updated throughout the year as needed.  Offense Codes are available in Word and Excel format  There are 3 different Word formats (Alpha, Statute and Code order) and one complete Excel file with tabs for each order.  There is also an Excel spreadsheet that shows the changes made since last version number.

OFFENSE CODES cont…  If the offense you are looking for does not appear to be in the offense code listing then please contact your field representative for assistance.  The DPS CJIS Supervisor will determine if a new code is needed, and if so, then one will be added and the appropriate agencies will be notified of the effective date. **(please keep in mind that a new code can take a while to add since it has to be added to several databases at DPS)**

9. General Offense Character (GOC) o Sec. 15.01. CRIMINAL ATTEMPT. (a) A person commits an offense if, with specific intent to commit an offense, he does an act amounting to more than mere preparation that tends but fails to effect the commission of the offense intended. (b) If a person attempts an offense that may be aggravated, his conduct constitutes an attempt to commit the aggravated offense if an element that aggravates the offense accompanies the attempt. (c) It is no defense to prosecution for criminal attempt that the offense attempted was actually committed. (d) An offense under this section is one category lower than the offense attempted, and if the offense attempted is a state jail felony, the offense is a Class A misdemeanor. o When an offense is Criminal Attempt of (A), Criminal Conspiracy of (C), Criminal Solicitation of (S) or Criminal Solicitation of a Minor of (M), the offense will be reported using the appropriate GOC Code, the 8 digit offense code of the offense related to the crime and the Level and Degree will be reduced by one.

10. General Offense Character (GOC)  Example:  Arrested for Criminal Attempted Burglary of a Building  GOC will be “A”  Offense Code will be 22990002 – Burglary of Building  The level/degree will drop from State Jail Felony to Misdemeanor A

11. Age of Victim Mandatory Offenses  Code of Criminal Procedure 60.051 (g).  If the offender is charged, prosecuted or disposed on any of the qualifying offenses, the Victim’s Age field must be filled out.  It is a two digit numeric field.  If the victim was under one year of age, then a 00 should be entered in the field and the age should be included in the Offense Literal field as 8 mos, 10 mos, etc.  If the victim is one year of age or greater, the number should be entered into the field as a whole number, 8, 10, 15, etc.

Class “C” Reporting  Report Class “C” Charges as a typical criminal submission over the Livescan.  A Class “C” charge should be the last TRS reported if multiple offenses occurred on that arrest event.  Agencies must use the generic Class “C” Offense codes provided by DPS, but must change the Offense Literal.  Agencies must also change the Arrest Disposition Numeric (ADN) to the “233” – Misdemeanor Class “C”, refer to Arresting Agency.  ** Note – the ADN must change to close out the charge to avoid compliance issues for the reporting county**

EDR FUNCTIONS  Provides Law Enforcement agencies with a way to modify or add charges electronically.**  Provides Prosecutor offices with a way to report their actions, and make corrections to a previously submitted action electronically. **  Provides Court Clerk’s with a way to electronically report their dispositions and FINAL dispositions to DPS.  CORRECTIONS CANNOT BE MADE ONLINE!!  Provides Court Clerk’s with a way to electronically report NICS to DPS.

30. Tips To Stay In Compliance  Frequently run Open Offense reports.  Run updated Compliance reports as cases are disposed.  Close out any open arrests.  Cases never filed with the prosecutor.  Cases never filed in court.  Report Absconded cases.  Meet with CJIS personnel regularly.

31. Completeness Reports (Grant Funding) The Texas Code of Criminal Procedure, Chapter 60, requires counties to report criminal history dispositions to the Texas Department of Public Safety (DPS). This information is used by law enforcement, judges, and many public and private employers to check criminal histories. Counties must have an average of 90% or above on both adult and juvenile disposition completeness and maintain timely reporting of all information as required by state law in order for any unit of government or non- profit agency within the county to be eligible for CJD funding.
