Information and communicationDirectorate general for Energy and Transport4 EUROPEAN COMMISSION DG TREN – E3 A) DEFINITION OF TRANSPORTABLE PRESSURE EQUIPMENT l The receptacles list in brackets in Article 2(1) is considered as non-exhaustive by the Legal Service l To avoid future misinterpretations, we propose to add “such as” in the beginning of the list and “gas cartridges” and “MEGC” to the list

Information and communicationDirectorate general for Energy and Transport5 EUROPEAN COMMISSION DG TREN – E3 B) TIME LIMIT FOR THE REASSESSMENT OF CONFORMITY l A long delay will make difficult the reassessment of conformity of existing equipment l To restring the reassessment of conformity application, we propose to add Article 5(1) with “…which shall perform it within (twice) the time defined for the periodicity of the inspection of the equipment…”

Π or CE mark, when the assessment is made according the requirements of PED? II. Which notified body, qualified according TPED or PED, is competent? III. CE marking on valves of transportable pressure equipment is in conflict with Art. 3(3) of PED? IV. Is the double marking possible on valves intended to be used on both equipment?

Information and communicationDirectorate general for Energy and Transport7 EUROPEAN COMMISSION DG TREN – E3 C) CE MARKING ON VALVES AND OTHER ACCESSORIES (2) l We propose that questions I, II and III are clarified with a new paragraph to Art. 3: “5. These valves and accessories shall bear the CE mark including those assessed in conformity with Art. 3(3) of PED, following the conformity assessment provided by a notified body, which was qualified according the same Directive.”

Information and communicationDirectorate general for Energy and Transport8 EUROPEAN COMMISSION DG TREN – E3 C) CE MARKING ON VALVES AND OTHER ACCESSORIES (3) l The proposition for clarification of question IV is an extension to Art. 10(2): “ …or they shall bear both marks if the conformity assessment is performed according the procedure laid down in Art. 3(3) of this directive and in Art. 10 of PED.”
