6 Option 3 – employing PA and services from an ‘agency’ Employment law guidance Where providers are seen in law as being an agency, they may be subject to ‘Agency worker regulations 2010’ … seek advice.

Staff employed by service provider (contract of employment) and has responsibility for sick leave, maternity and redundancy Service has responsibility for supervising, appraising and would discipline staff member Service in conjunction with service user – agrees support plan

8 Expectations of Care Service Providers Care Service category is appropriate (otherwise and illegally operating service) Provider informs SDS clients of boundaries and limitations of service – ensuring an informed choice is made Adherence to regulations (Requirements) and keep in mind NCS (recommendations) People choose registered care services as its regulated, have staff/contingencies Care Inspectorate – Investigate complaints

9 I nspection of care services - continue to use: Annual Returns Self Assessments PSR Act, Regulations and relevant NCS Lay Assessors/Service user carers Future – stakeholder feedback

10 Inspection and SDS Monitoring SDS through CI Annual Returns Advice to CI staff – include SDS clients in sample for Inspection activity SDS – similar to as self funding service users where purchasing registered care service Review service arrangements and registration
