Definition of Discrimination Discrimination is the treatment or consideration of, or making a distinction in favor of or against, a person or thing based on the group, class, or category to which that person or thing belongs rather than on individual merit. 4 Prince William County Human Rights Commission

The Equal Pay Act of 1963 o The Civil Rights Movement influenced the passage of the Equal Pay Act of 1963 o The Equal Pay Act of 1963 is a United States federal law amending the Fair Labor Standards Act, aimed at abolishing wage disparity based on sex. It was signed into law on June 10, 1963 by John F. Kennedy as part of his New Frontier Program. How to file a complaint Check list Did it occur outside of Prince William co unty? Did it occur more than 300 days after th e alleged action? Did you file with EEOC?

Follow the Complaint by e-mail, phone, letter or office visit 1. Contact PWC Human Rights by e-mail, phone, letter or office visit Complete an intake questionnaire 2. Intake Process - Complete an intake questionnaire Charge of Discrimination 3. File a formal job discrimination complaint called a “Charge of Discrimination” 4. Mediation 5. Investigation 6. Mediation o A mediation occurs before your complaint is investigated by PWHRC and provides you and your employer a chance to talk about your concerns. o If both parties agree to the terms of the mediation, the charge will be settled based on these terms and closed. o If Mediation fails it moves on to investigation. Investigation o The fact finding process o Review and analyze information received, interview witnesses or persons named in the charge, and obtain other information pertinent to the charge. 19 Prince William County Human Rights Commission

Probable Cause/ No Probable Cause o No Probable Cause - failed to bare the burden of proof that there was in fact an act of discrimination by the employer. o Probable Cause – evidence of discrimination was discovered. Prince William County Human Rights Commission
