2. MEDICAL MARIJUANA OVERLAY DISTRICT BYLAW Purpose: In November 2012, MA voters passed a ballot question allowing medical marijuana for patients with certain conditions. The proposed bylaw would regulate the location and operating rules of these facilities. Without a bylaw in place, Middleton would be exposed to having a facility in Town without local controls. State Law and Regulations: MA state regulations for medical marijuana facilities are among the strictest in the country. The State law sets a maximum of 35 facilities (called “Registered Marijuana Dispensaries” [RMD]) and no more than 5 per county. Two of these licenses have been issued for RMDs in Haverhill and Salem.

3. MEDICAL MARIJUANA OVERLAY DISTRICT BYLAW Location: RMD’s are allowed only in the newly created approximately 11 acre Medical Marijuana Overlay District, which is located off Birch Road in the Light Industrial District, and not within 500 feet of a school, day care center, or other uses that would likely involve children. Additionally, a RMD may not be located within 500 feet of any other RMD and they may not be located in moveable structures such as vans or trucks. Permitting: RMD’s must have a state license and are allowed only by special permit from the Zoning Board of Appeals, and permits are not transferable without approval of the Planning Board. All permits expire after five years but are renewable. Hours of Operation: RMDs may not operate between the hours of 9:00 PM and 8:00 AM.
