Points of Clarification Who are necessary members of an IEP meeting? Parents of the student; At least one regular education teacher of the student (if the student is, or may be, participating in the regular education environment); At least one special education teacher of the student or, where appropriate, not less than one special education services provider of the student; An administrative designee, also called a representative of the agency, who is qualified to provide or supervise the provision of specially designed instruction to meet the unique needs of students with disabilities, is knowledgeable about the general curriculum, and is knowledgeable about the availability of resources of the district; and, An individual who can interpret the instructional implications of evaluation results, who may also be a member of the team as described above. Authority: 34 C.F.R. § 300.321(a)(1)-(5) and Minn. R. 3525.2810, Subp. 1(B). The Following Members must be present at all meetings: Parents of the Child Regular Education teacher, if the child is participating the regular education A licensed special education teacher/provider The child must be invited (by transition age) A District Representative

Discretionary Members If The Conditions Warrant… Teacher licensed in the pupil’s disability if not already on the team A transition service provider/payor For a child enrolled in a private school, a representative of the school For a child in out of district placement, a representative from eh resident district For a child transition from Part C to Part B, a service coordinator or other representatives of the Part C C system by parent request 1 Parents and the district may include other individuals For Transition services a child must be invited to attend if post secondary goals will be discussed. Public agency must invite a representative of any participating agency that I likely to be responsible for providing or paying for transition services.

Discretionary Members If The Conditions Warrant… For a child who has been placed out of the district by the resident district, a representative from the resident district, agency or academy should be in attendance If placed out of district by a parent via school choice or open enrollment, a representative from the resident district is not required to be invited to the IEP team meeting. The LEA must ensure that a representative of the private school or facility attends the IEP meeting. If a private school or facility conducts the IEP meeting, the public agency must ensure that the parents and than agency representative are involved in any decision about the child’s IEP and agree to any proposed changes before they are implemented. If the representative cannot attend, other methods are used to ensure participation by the private school or facility, including individual or conference telephone calls.

Discretionary Members If The Conditions Warrant… For an initial IEP meeting for a child transitioning from Part C to Part B, an invitation to the IEP team meeting must be sent to the Part C service coordinator or other representative of Part C, at the request of the parent to assist in a smooth transition. In addition to the required team members of the IEP team, the reminder here is to include the Part B Service provider and District Representative.

Points of Clarification Written documentation …of parent agreement to the excusal must be included in the file corresponding to the specific IEP date. …of the input of the excused must be included in the file. Not acceptable to incorporate into the new IEP. Dates of excusal documentation must be - Prior t0 or Date of the IEP meeting.

Points of Clarification Parents must be informed that they do not need to consent to the excusal and that instead the meeting can be rescheduled. Parents may revoke consent of excused team member at any time. Discretionary team members do not require a written agreement or consent from a parent. The parent may request the meeting be rescheduled so that the team member may attend.
