Tell students that the Founders of the Constitution had to solve two problems: how to give the government enough power to preserve the nation, and how to provide safeguards to prevent the government from taking away freedoms and rights of the people. 2. Limited Government Magna Carta Government powers are limited to what is written in the constitution. Example: The police cannot search or seize your property without demonstrating cause and getting a warrant. (we have seen this before, magna carta and english bill of rights) A government whose powers are define and limited by a constitution.  Government must be conducted according to the Constitution and obey the law. Checks and Balances Definition: Each branch of government has some power over the other two branches.   Makes government less efficient but also less likely to trample on the rights of citizens Purpose: Preventing any one branch from having too much power. 5. Judicial Review Courts decide if government acts violate the constitution. Final authority on what the constitution says. Marbury v. Madison established judicial review 1803 Case   he declared that Madison should have delivered the commission to Marbury, but then held that the section of the Judiciary Act of 1789 that gave the Supreme Court the power to issue writs of mandamus exceeded the authority allotted the Court under Article III of the Constitution, and was therefore null and void. 1896 the courst rules "seperate but equal"  1954 What are the main principles of the US Constitution?
