Part-time faculty Filing for unemployment benefits OR It was a dark and stormy night...

... was there anyone who understood the plight of part-time faculty? 0 Part-time faculty members are temporary, at-will employees. 0 Part-time faculty members are not guaranteed continuing employment. 0 Receiving a Load Sheet for the following semester is not a guarantee of continuing employment. 0 Receiving a verbal or written agreement for classes is not a guarantee of continuing employment. The Scream by Edvard Munch

0 The Good News is that you get to apply for unemployment or reduced employment compensation! 0 Apply on the last day of the semester even if you haven’t received your final paycheck. 0 There is a one-week waiting period after you apply (an EDD week is Sunday – Saturday). 0 Apply online at http://www.edd.ca.gov/Unemployment/default.htm http://www.edd.ca.gov/Unemployment/default.htm 0 Or call EDD at 1-800-300-5616 (be prepared to wait... and wait... and wait...) Professional, dedicated faculty, who, after pondering their predicament, decide to apply for unemployment.

The application, it turned out, was easy, but oh so tricky! Some sample questions: 0 Do you expect to return to work for a former employer? 0 Do you have a date to start work? 0 Are you returning to work the next school session? 0 Has your employer given you reasonable assurance, either verbal, written, or implied, of returning to work for the next school session? Suggested answers: No, no, no, and no!

The night passed slowly as she clicked and reclicked the beads on the abacus. 0 You must provide 18 months of employment/salary history. EDD will base your claim on the highest quarter earnings. 0 The college’s payroll department should have this information. 0 Dates of employment mean the first day the semester began and the last day the semester ended. 0 Do not use the dates you received your paychecks.

Suddenly, the drip, drip of the rain was interrupted by the phone ringing... 0 You will receive a notice for the date and time of your phone interview. 0 A list of questions is provided on the back of the notice. 0 Keep your answers short! 0 Remember – you are not on semester break or recess. You simply don’t have a job 

In her darkest hour, she was denied benefits 0 If you are denied benefits, you have 20 days to appeal. 0 If you are a member of CCA, you are entitled to consult with a CCA representative. 0 Most claims are won at the first stage of appeal. 0 Cite the Cervisi Decision. The full text can be found on the CCA website. Go to cca4me.org. Roy Lichtenstein, Hopeless, 1963

But as the storm clouds cleared, she had reason to be hopeful... 0 Once your claim is opened, it is open for a year. You can reopen it to receive benefits during Winter Break. 0 Go to the EDD website and fill out the application to reopen your benefits. 0 You will receive a booklet titled A Guide to Benefits and Employment Services that answers most questions.

Help is on the way! 0 cca4me.org: click on “Issues & Action” click on “Part-time Issues” 0 Cathy Levitt – CODAA Executive Board 0 clevitt@collegeofthedesert.edu 0 Marianne Reynolds – CCA Staff Consultant, Region IV 0 mreynolds@cta.org (714) 978-8861 mreynolds@cta.org
