Legal Aspects Laws and Regulations can either facilitate or block progressiveness. Administrative Law - creates legal ambiguities and obstacles PSI Re-use raises complex legal issues when interlaced with jurisdictional contexts FOI and EIR should allow greater access, but fail due to lack of transparency

Public Sector Information Passive Administration has created data request denials, which has created an in-pass between PSIH and PSI Re-users. PSIH use Passive Administration to set high access and re-use fees to discourage requests. PSI Re-users become despondent and a lack of trust develops. Question – should Government intervene when Leadership Failures are discovered?

Commercial Problems and Academic Solutions The Academic Solutions Framework is behind the advances of the modern PSI Re-user PSI Directives are used as a ‘solution’ and do not take into account discriminations, passive administration, unfair competition, charging and access – all of the ‘real-time’ issues we face today. Solutions to our PSI issues will have to come from within the PSI Industry.

Engaging Academia Rob Davies (ePSIplus) and X-Press Legal Services to engage with Facultes Universitaries Notre-Dame De La Paix to share ‘data’, experiences and create a new level of understanding X-Press Legal Services will share ‘data’ with the European Commission eGovernment & CIP Operations including Information Society and Media Directorate-General

The Future The future is clear – The private sector has to share current problems with the Doctors, Ph. D’s and European Law Experts Greater knowledge exchange will educate the educators A unified approach from Academia and the private sector will stop passive administration
