4 Amendments 1987 – safeguards against use and handling of hazardous substances and procedures for setting up hazardous industries laid down.

5 objectives The objectives of the factories act 1948 are to consolidate and amend the law regulating labor in factories

6 Definitions Factory wherein 10 or more workers are employed manufacturing process is carried on with the aid of power - Wherein 20 or more workers are employed and manufacturing process is carried on without the aid of power

7 Worker a person employed directly or by or through any agency with or without the knowledge of the principal employer whether for remuneration or not

8 Occupier the person who has ultimate control over the affairs of the factory. Manager A manager is a person nominated or appointed as such by the occupier of the factory under section 7 of the act.

9 Hazardous process Any process or activity in relation to an industry, - Raw materials, wastes, etc.,

10 Applicability To all factories in the whole of india including govt factories

11 Exceptions This act is not applicable to the following - mines covered under the mines act 1952 - mobile unit of armed forces - a railway shed - a hotel, restaurant or eating place

12 Power to make rules The state govt are empowered to make rules and ensure the administration of the provisions of the act in their respective state. (the Tamil Nadu Factories Rules, 1950)

13 Obligations of employer Approval for the factory site from the respective state authorities Licence to be compulsorily obtained atleast 15 days prior to the opening of the factory Must ensure the health, safety and welfare of all workers while at work in the factory Registers to be maintained Notice of certain accident (sec 88) and dangerous occurrences(sec 88a)

14 Important registers to be maintained Form #8 – report of pressure vessels #12 registers of adult workers #25 muster roll #26 register of accident #26A – register of dangerous occurrences #28 register of exceptions # 34 nomination forms to be obtained from the employees # 36 report of examination of hoist or lift.

15 Important returns to be submitted Form #11 notice of
