Wisconsin Statute 182.0175 The contractor must expose (pot-hole) the underground utility facility at reasonable intervals Note: The utility company is not responsible to expose underground utility facilities

Conflict or Means and Methods Underground facility with 18 inches of excavation limits Overhead facility too close to crane Above ground facility with two feet of face of curb Underground facility cannot withstand weight of equipment Soil not stable so underground facility requires protection

Conflict or Means and Methods How was contractor anticipated to build project? What equipment was contractor anticipated to use? Specific equipment required to avoid utility conflict? Are plans and special provisions consistent? Contractor follow plan or did changes occur? Issue based upon law/engineering or convenience?

Plan calls for non-integral curb and gutter Contractor chooses to do integral curb and gutter Utility facilities two feet or more from face of curb No conflict so contractor responsible for all costs associated with adjusting utility facilities or working around them Example Conflict or Contractor’s Means and Methods

Work Plans approved with overhead wires over a bridge deck Special provisions and plan developed with the overhead wires over the bridge deck Bridge can be built with 10 feet of clearance between adequate equipment and overhead wires No conflict so contractor responsible for all costs associated with adjusting utility facilities or working around them
