4. ELIGIBILITY  ALL ELIGIBILITY RULES ARE PART OF SECTION 281-36.15 (280) OF THE IOWA EDUCATION CODE.  RULES ARE INTERPRETED AND ENFORCED BY THE IHSAA AND THE IGHSAU, HOWEVER, THEY ARE NOT WRITTEN BY THE GOVERNING ORGANIZATIONS.  THESE ELIGIBILITY RULES DO NOT APPLY TO MUSIC AND SPEECH.

6. LOCAL ELIGIBILITY AND STUDENT CONDUCT RULES 36.15(1)  GIVES LOCAL SCHOOL BOARDS THE AUTHORITY TO IMPOSE ADDITIONAL ELIGIBILITY REQUIREMENTS NOT SPECIFICALLY MENTIONED IN THE CODE.  MOST COMMON EXAMPLE – LOCAL GOOD CONDUCT POLICIES.

7. SCHOLARSHIP RULES 36.15(2)  A STUDENT MUST RECEIVE CREDIT IN AT LEAST FOUR SUBJECTS AT ALL TIMES.  PASS ALL AND MAKE ADEQUATE PROGRESS TOWARD GRADUATION TO REMAIN ELIGIBLE.  IF NOT PASSING ALL AT THE END OF A FINAL GRADING PERIOD, STUDENT IS INELIGIBLE FOR A PERIOD OF 30 CONSECUTIVE CALENDAR DAYS IN THE INTERSCHOLASTIC ATHLETIC EVENT IN WHICH THE STUDENT IS A CONTESTANT. THERE IS NO REQUIREMENT THAT THE STUDENT COMPETED IN THE SPORT PREVIOUSLY.  ELIGIBILITY BEGINS ON THE 31 st DAY.

8. OTHER SCHOLARSHIP RULE PROVISIONS  All contestants must be under 20 years of age.  Students may participate for a maximum of eight consecutive semesters.  A student is not eligible in a specific sport if they have participated in a contest with or against, or trained with a college team.  No student can be eligible in a specific sport if they have engaged in that sport professionally.

11. GENERAL TRANSFER RULE 36.15(3)  A student who transfers from a school in another state or country from one member or associate member school to another member or associate member school, shall be ineligible to compete in interscholastic athletics for a period of 90 consecutive school days. The period of ineligibility applies only to varsity level contests and competitions. The student will become eligible at 4:00 pm on the 90 th day.

12. EIGHT EXCEPTIONS 1)Upon contemporaneous change in parental residence. 2)Attending a new school districts as a result of a whole grade share between resident district and new district. 3)Subsequent return to live with parents in district of residence. 4)Unique circumstances. 5)New district and old district have a cooperative agreement - Only eligible in shared activities. 6)Parents change district of residence, student does not. 7)Special education student attending outside the district due to placement by district of residence - Eligible in either district but not both. 8)Transfer situations not provided for in the rule.

13. UNIQUE CIRCUMSTANCES 1.Adoption. 2.Placement in foster or shelter care. 3.Participation in a foreign exchange program. 4.Placement in a juvenile correction facility. 5.Participation in a substance abuse program. 6.Participation in a mental health program. 7.Court decree that the student is a ward of the state or of the court. 8.Child is living with one parent due to divorce, separation, death, or other change in the child’s parental relationship, or pursuant to a court- ordered decree of custody.

14. OTHER ELIGIBILITY CONSIDERATIONS  Students who are emancipated by marriage or having reached the age of majority – consider if move is for school or athletic purposes  Students who participate in the name of a member or associate school following the eighth grade is not eligible for 90 school days at the varsity level at another member or associate member school  FRESHMAN STUDENTS ARE ELIGIBLE IMMEDIATELY AT ANY MEMBER OR ASSOCIATE MEMBER SCHOOL SUBJECT TO THE PREVIOUS BULLET

15. OTHER ELIGIBILITY CONSIDERATIONS  STUDENTS ARE ABLE TO RETURN TO A PREVIOUSLY ATTENDED SCHOOL IF THEY RETURN WITHIN 30 SCHOOL DAYS.

17. OPEN ENROLLMENT TRANSFER RULE 36.15(4)  A student in grades 9 through 12 whose transfer of schools had occurred due to a request for open enrollment by the student’s parent or guardian is ineligible to compete in interscholastic athletics, during the first 90 school days of transfer except that student may participate immediately if the student is entering grade 9 for the first time and did not participate in an interscholastic competition for another school during the summer immediately following the eighth grade. The period of ineligibility applies only to varsity level contests and competitions.

18. NINE EXCEPTIONS 1)Participates in an activity in the receiving district not offered in the sending district. 2)Participates in an activity for which the sending and receiving districts have a cooperative program. 3)Has paid tuition for one or more years to the receiving district. 4)Has attended in the receiving district one or more years. 5)Has participated in open enrollment and the parents change district of residence – eligibility continues. 6)Has not participated in open enrollment but uses open enrollment to stay in the original district following a move of parents to a new district. 7)Obtains open enrollment due to the dissolution and merger of the former district of residence. 8)Obtains open enrollment due to the pupil’s district of residence entering into a whole grade sharing agreement 9)Participates in open enrollment and the parent/guardian is an active member of the armed forces

19. ELIGIBILITY FOR OTHER ENROLLMENT OPTIONS RULES 36.15(5)  Shared-time students. A nonpublic school student who in enrolled only part-time in the public school district of the student’s residence under a “share-time” provision for driver education in NOT eligible to compete in interscholastic athletics in the public school district.  Dual enrollment. A student who receives competent private instruction, not in an accredited nonpublic or public school, may seek dual enrollment in the public school of the student’s RESIDENT DISTRICT and is eligible to compete in interscholastic competition in the resident school district.

20. ELIGIBILITY FOR OTHER ENROLLMENT OPTIONS RULES 36.15(5)  Competent private instruction. A student who receives competent private instruction, and is NOT dual-enrolled in a public school, MAY participate in and be eligible for interscholastic athletics at an ACCREDITED NONPUBLIC SCHOOL if the student is accepted by that school. Application shall be made to the accredited nonpublic school on a form provided by the Department of Education.  Once students and their parents make the choice as to which school district, or nonpublic school, they want the student’s athletic eligibility to be in, the general transfer rule applies if they want to make a different choice.

22. FOREIGN EXCHANGE STUDENT ELIGIBILITY 36.15(3)(4)(3)  Immediate athletic eligibility, IF:  On a bona-fide foreign exchange program recognized by the school  Have not been recruited  Athletic participation was not a major concern in the student’s decision to become a foreign exchange student  Not 20 years old

25. APPEALS  THERE IS AN APPEAL PROCEDURE IN PLACE FOR ALL DECISIONS MADE REGARDING ELIGIBILITY. THE STEPS FOR APPEAL ARE AS FOLLOWS: 1)Seek an initial interpretation from an IHSAA administrator by telephone. 2)Get a written administrative ruling from the IHSAA as to the student’s eligibility. 3)If the administrative ruling is unacceptable, it can be appealed to the IHSAA Board of Control. 4)If the Board of Control’s decision is unacceptable, it can be appealed to the Director of the Iowa Department of Education. 5)If the Department of Education decision is unacceptable, it can be appealed to the District Court.

26. APPEAL TIME FRAME  The Board of Control hearing is at the next regularly scheduled meeting, but not later than 20 days after the receipt of the appeal. The written decision must be issued in 5 days.  An appeal to the Director of the Department of Education must be filed within 10 days of the mailing date of the governing organizations decision. The date for the hearing must be within 20 days after receipt of the appeal.  The Director has no time limit on when the decision must be issued.

36. OUT OF SEASON COACHING  281-36.15(g) a. School personnel, whether employee or volunteers, of a member or associate member school shall not coach that school’s student athletes during the school year in a sport for which the school personnel are currently under contract or are volunteers, outside the period from the official first day of practice through the finals of tournament play. Nor shall volunteer or compensated coaching personnel require students to participate in any activities outside the season of that coach’s sport as a condition of participation in the coach’s sport during its season.
