(c) St Patrick's Cathedral Grammar School Form 6 2005 Unfair Dismissal's Act 1997 The Unfair Dismissal’s Act 1993, protects permanent employees who are over the age of 16 and under the age of retirement.

(c) St Patrick's Cathedral Grammar School Form 6 2005 Reasons For Unfair dismissal… An employer cannot dismiss any employee for the following reasons… Trade union Membership, Sexual orientation, Race/Nationality, Age, Religious/Political Opinions, Pregnancy, Involvement of legal proceedings against the employer.

If an employee feels as if they have been unfairly dismissed then they can have their case investigated by either the Rights Commissioner or the Employment Appeals Tribunal. They will decide to either REINSTATE, RE-ENGAGE or COMPENSATE the employee.

(c) St Patrick's Cathedral Grammar School Form 6 2005 Reinstatement is when the employee returns to work and receives full compensation for their period of dismissal, with no breaks in their employment record. Re-engagement is when the employee returns to work with no breaks in their employment history, but does not necessarily return on the same terms and conditions. Compensation is when the employee does not return to work, but receives a cash payment for being unfairly dismissed.
