2 ASSAULT 1. Aggravated Assault – attack or attempted attack with a weapon whether or not injury occurs or without a weapon but serious injury occurs 2. Simple Assault – attack without a weapon with injuries requiring less than two days hospitalization. 3. Battery – attack by person to person that results in striking or touching the victim (battery is not recognized in New York State).
