3 PREA – community confinement PREA standard 115.212 (a,b) a.A public agency that contracts for the confinement of its residents with private agencies or other entities, including other government agencies, shall include in any new contract or contract or contract renewal the entity’s obligation to adopt and comply with the PREA standards. b.Any new contract or contract renewal shall provide for agency contract monitoring to ensure that the contractor is complying with the PREA standards.

4 PREA – community confinement Community Confinement Facility A community treatment center, halfway house, restitution center, mental health facility, alcohol or drug rehabilitation center, or other community correctional facility (including residential re-entry centers), other than a juvenile facility, in which individuals reside as part of a term of imprisonment or as a condition of pre-trial release or post-release supervision, while participating in a gainful employment, employment search efforts, community service, vocational training, treatment, educational program, or similar facility-approved programs during nonresidential hours.

5 PREA – community confinement PREA standard 115.401(a,b) a.During the three-year period starting August 20, 2013, and during each three-year period thereafter, the agency shall ensure that the facility operated by the agency, or by a private organization on behalf of the agency, is audited at least once. b.During each one-year period starting August 20, 2013, the agency shall ensure that at least one-third of each facility type operated by the agency, or by a private organization on behalf of the agency, is audited.

6 PREA – community confinement Each Agency is required to have 1/3 of their facilities audited by end of the Year One audit cycle (August 19, 2014). That means the audits must have occurred before August 20 th. If you don’t have your 1/3 audits completed on or before August 19, your Agency will be deemed non-compliant. If you have scheduled your Year One audits to occur into the Year Two audit period, your agency will now need to schedule 2/3 of your facilities to be audited on or before August 19, 2015.
