2. What is Copyright Law? In this presentation we will…  Examine what Copyright means.  Learn what is covered under Copyright Law.  Discover how we can use Copyrighted Media.  Discuss Copyright Infringement.  Look at different situations that involve Copyright Law.

3. What Does Copyright Mean?  Whenever someone creates something, they own what they have created.  That means that they are the only person that can distribute, photocopy, perform publicly, or publically display the work.  This includes “literary, dramatic, musical, artistic, and other intellectual works”. (from www.copyrightforkids.com)  What kinds of things have you created in class that you are proud of?

4. What is Covered Under Copyright Law?  Any literary work (book, essay, blog, website, short story)  Musical works (songs, concerts, performances)  Plays and Musicals  Dances  Pictures, Sculptures, and Paintings  Movies  Sound Recordings  Building Designs

5. What is Not Covered Under Copyright Law?  Ideas that are not written down or recorded.  Names.  Common Knowledge that contains no originality.  Works by the United States Government.

6. How Can We Use Copyrighted Material? Fair Use:  Get the permission from the person who made the work.  If the material is used for Educational or Research purposes.  If material is used by a Non-Profit Organization.  A small portion of the total work is used.  The work is mostly factual.  The work is in the Public Domain.

7. What is Copyright Infringement?  When someone uses copyrighted material without the permission of the creator.  When material use does not fall under the “Fair Use” policy.  If caught you may need to go to court and pay the author monetary compensation.  If you follow correct rules you will not get in trouble. Now that we have learned about Copyright rules, let’s look at some situations that involve using different materials.

8. Situation #1 Julian is looking for a picture for his Explorer project. He finds a great picture on a website that was drawn by a professional artist in 1997. Can he safely use this picture? What should he do? Think about: What is his intended purpose for the picture? Does the date have an effect on the use? Does the author have an effect whether he uses it? Julian can use the picture without any problems. Julian cannot use the picture for his project. Julian should email the author and make sure it is OK to use the picture. 9. Good job! Julian should be fine using the picture since it is being used for an Educational project. If he wanted to be extra safe he could contact the author of the picture and gain his/her permission. Click to go to next situation Click to go back to situation

10. Even though there is a small possibility of Copyright Infringement, Julian should not be worried about using the picture. It is good to be cautious, but in this situation he should be OK. Click to go to next situation Click to go back to situation

12. Situation #2 While doing research for the Explorer project Marissa finds a website logo that she really likes. She doesn’t want to use it for the project, but she would like to use it for a flyer she is making up for her softball team. Should Marissa use the logo? Think about: What is his intended purpose for the picture? Does this have an effect on Marissa using the logo? Are there any other possible problems with using the logo? Marissa can use the logo without any problems. Marissa cannot use the logo for her flyer. Marissa could use the logo for the project but cannot use the logo for the flyer. If she wanted to use it for her project she should be OK, but since the flyer in neither for education or research, it could fall under Copyright Infringement. 16. Situation #3 Mark and Joslyn have found picture of the area that Columbus explored. The picture was taken by a photographer hired by the United States Government and was taken in 1903. Can this picture be used for the Explorer project? Think about: What is his intended purpose for the picture? Does the date have an effect on the use? Does the author have an effect whether they uses it? They can use the pictures with no problems. They cannot use the pictures for their project. 17. You are right! Since the picture is owned by the United States government it is public domain. The picture is also over 70 years old so there is a good chance that even if it wasn’t owned by the government, it would still be public domain. Click to end show Click to go back to situation
