1.Yuzhny pilot s tation is within Nikolaev port; 2.Yuzhny is the usual and mandatory waiting place for ships calling at Nikolaev port, and/or 3. NOR for ships bound to Nikolaev port can be validly tendered at Yuzhny pilot station. 1.Yuzhny pilot station is actually situated at the approach to Eastern roads of Nikolaev port. 2. It is within the geographical area of Nikolaev port. 3. Pilotage to the port of Nikolaev area is compulsory for foreign vessels. and 4.Pilots embark and disembark at the approach to the outer roads of Yuzhny. Lord Reid in The Johanna Oldendorff [1973] Under a port charterparty, a vessel becomes an arrived vessel for the purpose of calculating laytime once she arrives within the confines of the port. Test: whether the vessel was at such a place within the port that she was at ‘the immediate and effective disposition of the charterers’. Conversely, if she is at some other place within the port, then it is for the owners to show that she is nonetheless at the charterer’s disposition.
