Re-cap of why changes are being made PUCT Project #31972 Informal/Unofficial summary –Among other changes, the PUCT project increased offer caps and market transparency/reporting requirements (Substantive Rule 25.505) –Project History: PUCT Project Initiated in 2005 Adopted 8/10/06 Effective 10/1/06- ERCOT developed an series of reports and special webpage to meet the requirements (http://www.ercot.com/gridinfo/sysplan/index.html )http://www.ercot.com/gridinfo/sysplan/index.html –A successful lawsuit filed to suppress changes to many disclosures –ERCOT filed PRR697 to codify data posting changes in Protocols Approved by ERCOT Board on 4/18/07- (boxed language in protocols for lawsuit) –PUCT project 33490 approved to modify disclosure timing, resulting in lawsuit being dropped/dismissed 9/19/07 –Commission staff communicated that 9/22/07 shall be effective date for disclosures

Implementation Update since last DEWG meeting –2 Market Notices and Whitepaper released Market Notice sent 11/7/07 advising market of disclosure timing changes –M-B110707-01 Entity-Specific Disclosures Required by P.U.C. SUBST. R. 25.505 60-day extract Market Notice sent 11/21/07 –M-B110707-02 60-day Posting of Balancing Energy and Ancillary Services Bid stacks Three disclosures will be changed from monthly 180-day disclosures, to daily 60-day disclosures. The three impacted reports are: –Individual BES Bid Information- (https://pi.ercot.com/contentproxy/publicList?folder_id=10001838)https://pi.ercot.com/contentproxy/publicList?folder_id=10001838 –Individual AS Bid Information- (https://pi.ercot.com/contentproxy/publicList?folder_id=10001829)https://pi.ercot.com/contentproxy/publicList?folder_id=10001829 –Individual Replacement Bid Information- (https://pi.ercot.com/contentproxy/publicList?folder_id=10001847)https://pi.ercot.com/contentproxy/publicList?folder_id=10001847 The ongoing 180-day extracts (which are monthly reports) will continue to post every first Tuesday of the month to coincide with those Operating Days prior to September 22, 2007, which are subject to 180-day disclosure and will continue to be posted through April of 2008. The new daily 60-day disclosure files will begin posting December 6, 2007.

Implementation Delivery of 90-day extracts still under review –Working with PUCT on implementation date other than 12/22/07 –Interplay with AIX migration and system lockdown over holidays has delivery in late-January unless manually performed –Modifies 3 extracts Energy Schedules Report: Final energy schedules by entity by area for each settlement interval.Energy Schedules Report –Change required – Change from 6 months to 90 days. Implementation Whitepaper released –Per DEWG request ERCOT Drafted Whitepaper and sent to DEWG 11/12/07 including Commission Language and Protocol Language Discussed the issue of new and modified extracts Discussed issue of Day-Ahead Report No feedback to date –Regarding the Day-Ahead report and A/S bidstacks ERCOT will be looking to change the timing of the AS bidstack, and removal/zero’ing of Quantities from Day-Ahead Report –The earliest this would occur is January 2008 with the 90-day extract changes –Parties that disagree with this change are asked to draft PRR to consider changes to section 12.4.4.2.3.2
