October 2014 Page 3 Air Quality Successes Emissions Inventory: –Between 2000 and 2012, NO X emissions decreased 63%, and measured ground level ozone concentrations decreased 23% Ozone Levels: –From 2000 to 2013, ozone levels in Texas have decreased by 24% –Average for all states plus District of Columbia and Puerto Rico only showed a decrease of 12% Eight-hour ozone levels for HGB and DFW nonattainment areas have been trending downward for the 1997 eight-hour NAAQS since 2000

October 2014 Page 4 Air Quality Successes As of 2013, eleven areas of the state with monitors have ozone levels below the 2008 ozone standard The EPA has designated the El Paso area to be in attainment of the 1997 ozone standard The EPA has re-designated the Beaumont area in attainment of the 1997 ozone standard

October 2014 Page 6 DFW “Bump-Up” Background: –DFW area did not attain the 1997 eight-hour ozone standard by its June 2013 attainment date –EPA proposed rules for 2008 implementation, which included revoking 1997 standard Sierra Club Lawsuit and EPA Consent Decree: –February 2014: NOI to sue EPA for failure to take action –If the consent decree establishes a reclassification deadline before the expected effective date of the 1997 standard revocation (April 2015), the DFW area would be reclassified as severe nonattainment

October 2014 Page 9 Upcoming NAAQS Monitoring PM 2.5 and CO - DFW and HGB to be operational by January 1, 2015: –Austin-Round Rock and San Antonio areas to be operational by January 1, 2017 NO 2 - Near-road monitors required in DFW, HGB, Austin-Round Rock, and San Antonio areas (one in each): –Second near-road monitors required in DFW and HGB areas by January 1, 2015 –El Paso and Edinburg-Mission-McAllen area monitors required by January 1, 2017 SO 2 – data requirements rule - ??

October 2014 Page 10 Regional Haze EPA has not taken action on the initial Regional Haze SIP submittal (March 2009) Under a consent decree, the EPA is scheduled to propose action by November 26, 2014 and take final action by September 4, 2015 Next Regional Haze SIP is due in July 2018: –It takes years to develop EPA may require a four-factor analysis of each facility that may impact visibility at Class I areas inside and outside of Texas: –The TCEQ does not have authority to require facilities to perform this analysis themselves for submittal to the TCEQ. This may require rulemaking. –30 - 40 sources
