2. Reclamation Plan Project Purpose: To Satisfy Syar’s Reclamation Obligation under SMARA for the Healdsburg Terraces (Basalt, Phase I, Phase II and No Name Ponds) as Required by the Currently Approved Reclamation Plan. To Change the Project Design from the Controlled Pond Filling Structure (Weir) to Earthen Connecting Channels between the Russian River and the Healdsburg Terrace Ponds. To Provide for the Designated End Use of Open Space. To Provide for a High Water Connection to the Russian River to Help Prevent River Capture.

3. RECLAMATION PLAN AREA PROJECT AREA INCLUDES BASALT POND, PHASE 1 AND PHASE II PONDS, AND NO NAME POND. PHASE IV IS NOT INCLUDED IN THE PHASE II RECLAMATION PLAN, HOWEVER IT WILL BE CONNECTED TO THE OTHER PONDS FOLLOWING THE COMPLETION OF THE PHASE II PROJECT.

Phase II Mining Site Chronology 1967-85 Basalt Rock Company mines the Basalt Pond and Phase I Pond. 1986 Syar purchases the Sonoma County interest of Basalt Rock Company. 1989 Syar completes mining in the Phase I area and applies for a permit to mine in the Phase II area. 1990 Syar receives approval of the Phase II permit and EIR and commences mining. 1991 Syar’s Phase II permit is challenged and the BOS is required to set aside permit. 1992 Syar submits a new M & R Plan to mine in Phase II, which included reclamation of the Basalt, Phase I and Phase II areas. 1993 The BOS certifies the Phase II EIR and approves the Phase II permit, which was then challenged again. However, Syar Commences Mining. County Commences River Capture Study with Baseline Environmental. 1994 Syar Completes Mining in Phase II and Commences Reclamation. 1996 Baseline completes “Evaluation of Channel Stability and Potential Slope Failure” report to satisfy opposition’s concerns, mitigations to the Phase II EIR were added. 1997 BOS approves revisions to the Phase II permit that included designed connection(s) between the ponds and the Russian River. 1998 -99 Syar designs a weir structure that would allow for the controlled filling of the Phase I, Phase II, Basalt, No-Name and Phase IV ponds during major flood events. Permits are granted to construct the weir.

6. 2001River Watch files lawsuit against City of Healdsburg’s continuing to dump treated sewage into Basalt Pond, thus stopping the construction of Syar’s overflow weir. 2003Syar continues reclamation work on Phase I, Phase II slopes. 2004-06A United States Federal Court Judge and 9 th Circuit rules that the City of Healdsburg is in violation of the Clean Water Act and determines Basalt Pond to be “Waters of the United States”. 2007Syar re-applies for permits to construct overflow weir and since the Basalt Pond was now considered “Waters of the United States”, the US Army Corp of Engineers (COE) had jurisdiction and requested a Section 7 Consultation from the National Marine Fisheries Service (NMFS). 2008 NMFS makes informal decision that because the overflow weir could potentially cause entrapment of endangered fish and a jeopardy opinion could be given by NMFS. Discussion with NMFS continued and a concept of opening up the river levee for a seasonal connection of the Russian River was developed. Syar begins collecting data on temperature within the ponds. 2009Syar helps sponsor Gravel Pit Symposium organized by NMFS to discuss benefits for endangered fish to be able to mature in gravel ponds, thus improving survivability. At the request of the Regional Board Syar performs water and sediment sampling in terrace ponds to determine levels of constituents of concern. Syar continues to meet with Sonoma County PRMD and Interagency Group to discuss requirements of opening the river to the terrace ponds. Phase II Mining Site Chronology (Continued)

7. 2010Syar submits a new Reclamation Plan for the Phase II area which includes the newly designed connections. Syar receives comments from PRMD on Revised Master Reclamation Plan. Syar meets with NMFS and Interagency Group (IG) to discuss the proposed Reclamation Plan. 2011Syar re-submits draft Reclamation Plan and draft Biological Assessment (BA) for Phase II. Syar meets with IG and strongly states that their project for the Phase II area is strictly a mining reclamation plan and is not a fisheries restoration plan. The IG requests that Syar revise the draft Biological Assessment to provide more detail on hydrology and fish impacts due to stranding and predator fish. The IG requests that Syar do additional studies on water temperature and dissolved oxygen level in the Basalt, Phase I, Phase II and Phase IV ponds. This study is currently being conducted.
