Housing Department Staff Recommendation Approve key terms of 2 nd Amendment to Development, Loan & Lease Agreement with Heritage Square Housing Partners, LP CEQA exemption for Historical Resource projects Amend scope to include Decker House relocation as developer’s responsibility Relocate Decker House to Heritage Square South Amend FY 2015 dept. operating budget and approve appropriation of $225K from Inclusionary Fund balance for Heritage Square project 2

Housing Department Staff Recommendation Appropriation will increase City loan to developer by $225K to fund cost of Decker House relocation Costs include development of plans, Historic Preservation process for approval of Certificate of Appropriateness, lead-based paint testing and abatement, two moves, cribbing for temporary relocation, grading, permanent concrete foundation, permit fees, contingency, prevailing wage Developer will do advertised bids for the relocation and outreach to subcontractor workshop attendees 3

Housing Department Northwest Commission Northwest Commission action on 1/22/15 Recommended City Council approval of staff recommendation, but with a provision that contracts between City and developer include a “24-hour construction clause.” City law does not allow 24-hour construction: activity limited to 7 a.m. – 7 p.m. Mon-Fri and 8 a.m. – 5 p.m. Sat (PMC, Section 9.36.070) Construction contract between developer and Dreyfuss already provides for additional work shifts or overtime if necessary to expedite the project. Staff did not incorporate a “24-hour construction clause” in the recommendation to City Council 4

Housing Department Heritage Square South Incorporate house into Heritage Square South Rehab and final use of the house will be part of Heritage Square South developer’s responsibility House to be rehabilitated to the Secretary of Interior Standards RFP for Heritage Square South anticipated to be issued by end of this calendar year 5
