2.  DISH is located in North Texas. Just north of the Texas Motor Speedway, in Denton County, TX.  DISH has a geographic size of two square miles and a population of about one hundred and eighty citizens.  Including our extra territorial jurisdiction, the population increases to roughly five hundred.

3.  DISH was originally incorporated as Clark in 2000.  In 2005 the name was changed to DISH in exchange for ten years of free dish network.  The media coverage of this name change was comparable to Apple’s release of the iPod.  DISH’s annual budget is around $70,000.00  DISH has won the title of fittest city in Texas 3 times.

4.  For the past several years has been the most active natural gas shale in the United States.  During the boom just a few years ago it added 8-10 Billion Dollars annually to the Texas economy.  During the same period the Barnett Shale accounted for 100,000 jobs in the State of Texas.

5.  An underground highway of pipelines exist to extract the natural gas from the Barnett Shale.  Eleven high pressure natural gas pipelines converge on DISH.  Five companies have installed eleven natural gas compressors as well as associated treating facility.  Home to four natural gas metering stations.  Around eighteen natural gas wells.

Complained about odor for over a year.  Industry and state regulatory agencies alleged odorant was cause of smell.  Odor increasingly got worse.  Industry performed study.  Study showed no leaks that could cause odor detectable by the human nose.  Did not check for any toxins that may cause odor.

11.  Town of DISH paid approximately 15% of our annual budget to have an independent air study.  Study was performed by Wolf Eagle Environmental Engineers and Consultants.  Quote from air study: ◦ “Laboratory results confirmed the presence of multiple Recognized and Suspected Human Carcinogens in the fugitive air emissions present on several locations tested in the Town of DISH”.

12.  Samples were taken at seven locations on private property.  All but one of the samples showed exceedences of Effects Screening Levels (ESL).  Sixteen toxins exceeded either short term and long term ESL.  The highest recorded level of Carbon Disulfide was 107 times the long term ESL.  TCEQ validated the concern for health for the amount of benzyne detected in that air study in an internal memo.

13.  Phase I, August 26 -27, 2009 ◦ Study looked at 12 sites. ◦ Emission sources were identified at 11 of the 12 sites.  Phase II, October 9-18, 2009 ◦ Found a maximum benzene concentration of 1000 parts per billion by volume (ppbv) and hourly average of 540 ppbv was detected at a facility just west of DISH. The short term ESL for benzyne is 180 ppbv.

14.  DISH Citizen Health Assessment  Continued Monitoring  Exploring all options to clean up site.  Perform mapping to determine the extent of the exposure.  Perform analysis to determine how the detected toxins interact.  Please help if you have any suggestions.
