2 The Basics: Part 1 What is copyright? What is Public Domain? What does copyright apply to? What is not protected by copyright?

3 What is copyright? Literally, “the right to control copying” exclusive legal right of an originator to print, publish, perform, film, or record literary, artistic, or musical material…. …and to authorize others to do the same.

4 Who owns the copyright?  (Generally) the creator of the work  Originality is a requirement!

5 What is public domain?  belongs to everyone and is not protected by copyright. Consists of Works: Ineligible for copyright Where copyright is expired Benefits: No permissions required Ease of distribution Generation of creative content

7 What is NOT protected by copyright? Pre-existing material Ideas, facts, themes – not original! most titles, names, slogans, catch-phrases History and news Procedures and processes The above are all in public domain! the expression of ideas, etc., are protected

9 How to protect your own work What do I have to do to protect my work?  ABSOLUTELY NOTHING!  copyright exists automatically

10 How to use copyrighted works the owner is protected under copyright common law A copyright notice is not required Not mandatory to register because it does not enhance protection, but…  can be used as evidence in court  Easier to ask for permission from you to use your work

11 How to figure out if the work you want to use is copyrighted ALL original work is copyrighted, unless ineligible/ expired Remember: A work does NOT need to be registered, published, or have a copyright notice on it to be protected by copyright. If a notice is used, you will see  the symbol - ©  the date  the name of the owner
