Act 153 and Act 168 Update February 3, 2015 Pequea Valley School District

2 Act 153 – Clearance Law Active employees need all three clearances (FBI, Child Abuse, and State Police) updated every three years Clearances dated prior to January 1, have until December 31, 2015 to be updated Clearances dated January 1, 2012 or later have three (3) years from the date of the anniversary of the respective clearance to be updated

3 Act 153 – Clearance Law New employees no longer can have clearances dated within 1-year of hire Department of Human Services DHS is now offering Child Abuse Clearances online effective January 1, 2015 Expectation of backlog for clearances at the end of 2015 could be significant Similar volunteer requirement effective July 1, 2015

4 Act 153 – Clearance Law What if a single clearance is older than 3 years on January 1, 2012 but all of the other clearances are less than 3 years old? Who has to pay for the clearances? Does the school need to see original clearances? What if an employee’s clearance becomes out-of-date? Can IU13 help with the FBI fingerprinting process?

5 Act 168 – Employment History
Otherwise known as “Pass the Trash” All employees hired on or after December 22, 2014 must comply with employment history review requirements Applicant completes PDE form and returns to school employer School must contact any previous employer or organization where applicant worked or volunteered and worked with or had direct access to children

6 Act 168 – Employment History
Previous employer/organization must respond within 20 days of contact Failure to respond to request for information is subject to criminal/civil penalty Affirmative response may allow school to hire applicant – additional form required by employer/organization Your school will have many incoming forms as need to create a process to track outgoing forms

What if an employer no longer is in business? What if an employer refuses to cooperate? What if an applicant doesn’t disclose a previous employer on their application? May I hire an applicant while the Employment History Review is in process? How long must I maintain forms on newly hired staff?
