Elizabeth Benson Energy Associates3 Independent Monitors Two Independent Monitors (IMs) to ensure Fall 2006 RFP design, solicitation, evaluation and selection are objective and impartial, and that no undue preference is provided to Entergy competitive affiliates - Process IM – Elizabeth Benson - Evaluation IM – Potomac Economics Operate under the requirements of the LPSC’s Market-Based Mechanisms Order Detailed roles described in Proposed Scope of Work Activities posted to RFP Website - Comments welcomed during draft RFP period

Elizabeth Benson Energy Associates4 RFP Process Codes of Conduct - All employees of ESI, Entergy Operating Companies, Competitive Affiliates (including those involved in RFP) must observe required Affiliate Rules and Codes of Conduct - Detailed in RFP. Link to documents on RFP Website RFP Evaluation Teams - Composed of designated personnel. Composition and activities overseen by Process IM - All personnel involved with RFP evaluation required to adhere to confidentiality acknowledgement governing access to and uses of proposal information RFP’s Appendix G contains detailed information on protecting proposal information and related protocols

Elizabeth Benson Energy Associates5 RFP Process Managing Proposal Information All Bidders, resources and proposals receive randomly generated identification numbers to mask their identity Proposal information is distributed to designated RFP evaluation teams on a “need-to-know” basis only – e.g., - economic evaluation - pricing, availability, dispatch flexibility info. - transmission evaluation - detailed location information, but no pricing Electronic processing separates proposal information automatically into data reports for each RFP evaluation team The Process IM reviews all proposal information in detail (and redacts, as needed) before data reports are distributed to RFP evaluation teams

Elizabeth Benson Energy Associates6 RFP Process Communication Before Proposal Submission Entergy’s RFP Website is the principal means of communication All RFP questions/issues should be directed to Ms. Laura Berryman, the RFP Administrator, according to the process outlined in Section 2.5 of the RFP - individuals needing to contact the IMs should contact Ms. Benson All questions about the Entergy Transmission System should be directed to Entergy’s Transmission Business Unit (TBU) through its OASIS website as detailed in Section 2.6 of the RFP An RFP “Hotline” will be available from October 30 through November 16 to help Bidders with questions regarding electronic registration and proposal submission Unapproved contact about the RFP with ANY other ESI employee is prohibited

Elizabeth Benson Energy Associates7 RFP Process Communication During The Evaluation Communication with Bidders during the initial evaluation process is expected to occur only if RFP evaluators need to obtain clarifying or additional information on proposals - Evaluators will contact Bidders through the RFP Administrator to obtain any needed information Bidders should direct any questions about the RFP to the RFP Administrator - Bidders needing to contact the IMs should contact Ms. Benson Any communication with Bidders will be under the supervision of the Process IM Any inquiries about the Entergy Transmission System should be directed to Entergy’s Transmission Business Unit (TBU) through its OASIS website as detailed in Section 2.6 of the RFP

Elizabeth Benson Energy Associates8 RFP Process Stakeholder Process The objectives of the RFP Stakeholder/Question & Answer Process are: To encourage questions about and input to the Draft Fall 2006 RFP (September 1 – 29, 2006) To ensure to the maximum extent that all Bidders have equal access to information that may be potentially relevant to their proposals To minimize the need for any party to disclose confidential information To ensure compliance with all applicable affiliate rules, codes of conduct and other information sharing rules
