Follow-up to the Sixth Round of mutual evaluations 19-21 November 2014 Rome 43 rd Plenary Meeting of the European Judicial Network

Key findings on EJN  The general assessment on the operation of the EJN in the Member States is positive.  The operational flexible and cost effective structure of the EJN has been appreciated as an added value.  The role of EJN Contact points in the ENCS is very important for improving the coordination and ensuring that a case is dealt with by the structure which is better placed.  Criteria for appointed CPs: substantive knowledge on judicial cooperation in criminal matters; language knowledge.  The IT tools provided in the EJN website need to be further enhanced and permanently updated.

EJN involvement EJN Secretariat was involved throughout the evaluation process, although it did not have the possibility to participate with observers in the on site missions. EJN Contact Points have actively participated, some of them as experts nominated by their MS.

EJN (Secretariat) follow-up measures At the 6 th NCM meeting, the EJN Secretariat has proposed a follow-up methodology. An in-depth and comprehensive analysis of all 28 country reports and of the final report, by the EJN Secretariat with support from an ad-hoc group of EJN CPs. On 12 November 2014, the EJN Secretariat has sent to the General Secretariat of the Council its preliminary comments on the first draft of the final report.

Next steps Once all the reports will be declassified, the EJN Secretariat, in consultation with Eurojust and the established ad-hoc group, will prepare a document for the next regular meeting. The analysis will take into account not only the recommendations of interest for the EJN, but also the whole substantive part of the reports, as well as the findings from the EJN Bi-annual reports.
