3  Europe’s leading alternative telecom operator  Tele2's mission: to provide price leading and easy-to-use telecoms services  Tele2 offers fixed and mobile telephony, broadband, data network services and cable TV to 25 million customers in 15 countries  Operating revenue 2007 SEK 43.4 billion;  Tele2 was founded in 1993. It has been a tough challenger to the former government monopolies and other established providers  Listed on OMX Nordic Exchange since 1996 Tele2 – Who are we?

4 Need for further harmonisation Non intervention by NRA: On a number occasions NRAs have failed to intervene in spite of clear breaches of the regulatory framework Article 7 process : suspension of regulatory decision is welcome but should be only granted when a irreparable harm could occur. Commission’s veto power on remedy combined with a strong role of the authority would ensure that remedies necessary to promote competition are effective and applied without delay in a consistent way. A periodic review of SMP analysis would ensure remedies are still accurate regarding new competition developments Functional separation should be considered a realistic and positive remedy to foster competition and consumer welfare (e.g. Ireland, Sweden, Italy) Timing of the review is of essence Authority: Harmonisation and consistency of implementation should be the guiding principles of the authority. It should also take a coordinating role rather than a replacement role with NRAs. Finally, more clarity should be given how it would interact with CEPT and RSPG.

5 Stimulating investments Clear, transparent and foreseeable rules and regulations at both EU and national level Ex ante rules creating a level playing field, paving the way for ex post monitoring Why is Europe suffering from low investments? –Lack of certainty regarding NGA – safeguarding made and future investments –Hidden barriers raised by incumbents to access –Slow and inefficient NRAs – independent experts –Non harmonised decisions by NRAs How can the investments be increased? –Functional separation of existing and future networks will create clear, transparent and foreseeable rules and stimulate further investments –Emergence of Pan European telecommunication services –New opportunities via flexible spectrum rules and new availability of new spectrum

6 Conclusion – Tele2´s call for action at EU-level Harmonisation – more consistency in the application of the framework –not inventing new remedies but consistency of their application –new authority (EU-com powers) not the issue and not solution in it self Mandating functional separation is a must to ensure competition today and particularly tomorrow – NGN - Investment Tele2 welcomes the push for better consumer information –Industry can and should act voluntarily in co-operation with NRAs and consumer organisations Timing of the review and its implementation is of essence Let´s create a single market for telecoms – to the benefit of all consumers
