..This day have I perfected your religion for you, completed My favour upon you,.. 5:3
قال رسول الله ‏ ‏صلى الله عليه وسلم ‏ ‏“من أحدث في أمرنا هذا ما ليس فيه فهو رد“ البخاري
‏كان رسول الله ‏ ‏صلى الله عليه وسلم ‏ ‏يقول في خطبته يحمد الله ‏ ‏ويثني عليه بما هو أهله ثم يقول ‏ ‏من يهده الله فلا مضل له ومن يضلله فلا هادي له إن أصدق الحديث كتاب الله وأحسن الهدي هدي ‏ ‏محمد ‏ ‏وشر الأمور ‏ ‏محدثاتها ‏ ‏وكل محدثة بدعة وكل بدعة ضلالة وكل ضلالة في النار .. النسائي

‏‏عن النبي ‏ ‏صلى الله عليه وسلم ‏ ‏قال ‏ ”‏من سن في الإسلام سنة حسنة كان له أجرها وأجر من عمل بها من بعده من غير أن ينتقص من أجورهم شيء ومن سن في الإسلام سنة سيئة كان عليه ‏ ‏وزرها ‏ ‏ووزر ‏ ‏من عمل بها من بعده من غير أن ينتقص من ‏ ‏أوزارهم ‏ ‏شيء“ أحمد
عن عمر (رض) قال عن جماعة التراويح: ”نعم البدعة هي“

Agreement of the Scholars in a certain time on a ruling..
If anyone contends with the Messenger even after guidance has been plainly conveyed to him, and follows a path other than that becoming to men of Faith, We shall leave him in the path he has chosen, and land him in Hell, what an evil refuge! 4:115

مساواة الفرع للأصل في علة حكمه
أركانه: الفرع، والأصل، والعلة، والحكم.
Extrapolating a ruling on a new issue (branch) after a comparison with an original ruling (origin), because of mutual link in the reason behind the original ruling.

مساواة الفرع للأصل في علة حكمه
أركانه: الفرع، والأصل، والعلة، والحكم.
(الحشيش كالخمر في الحرمة للإسكار).
فالحشيش فرع لأنه يقاس على شيء آخر ويلحق به.
وكالخمر: هو الأصل، لأنه المقيس عليه.
وفي الحرمة: هو الحكم، لأنه الوصف الشرعي المنقول من الأصل إلى الفرع.
والإسكار: هو العلة التي من أجلها شرع الحكم في الأصل، وبسبب وجودها في الفرع مساوية للأصل نقل الحكم من الأصل إلى الفرع.

Definition:
الصحابي عند الأصوليين: هو من لقي النبي (ص) مؤمنا به ولازمه مدة طويلة بحيث يجوز إطلاق لفظ الصاحب عليه عرفا ولغة
(أصحابي كالنجوم بأيهم اقتديتم اهتديتم)
Companion: Who met the Prophet PBUH, believing in him, and stayed with him enough time learning and keeping company with him, so it is acceptable by social customs and language to call him a “companion”

Definition:
هو ترك القياس الظاهر لدليل اقتضى هذا الترك.
عن عبد الله بن مسعود (ما رآه المسلمون حسنا فهو عند الله حسن)
Preference: to leave the ruling of Comparison for a better reason.
Accepted by Abu Hanifah. Used by Ahmad and Malik. Rejected by Shafe’i
Example: Cleanliness of water used by meat-eating birds, compared with animals. سؤر سباع الطير

Definition:
والعرف ما استقر في النفوس من جهة العقول وتلقته الطباع السليمة بالقبول .
قوله تعالى: (خُذِ الْعَفْوَ وَأْمُرْ بِالْعُرْفِ وَأَعْرِضْ عَنِ الْجَاهِلِينَ) الأعراف:199
المراد بالعرف فيها الشيء المعروف المستحسن
Common Practice: Matters that are wide-spread in daily living affairs, accepted by intellectual and righteous people.
Condition: No contradiction with any Islamic practice or textual evidence.

Definition:
الحكم ببقاء أمر كان في الزمان الأول ولم يظن عدمه .
Preserving Status Quo : Keeping the ruling or the status on an issue as is, if not proven otherwise.
Example: When in doubt whether ablution (wudu) has been spoiled, the state of wudu is not rejected just by suspicion.
